1. Bring in the order of the Government of the Republic of Kazakhstan of April 6, 2005 No. 310 "Some questions of the Ministry of Agriculture of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2005, No. 14, the Art. 168) the following changes:

Regulations on the Ministry of Agriculture of the Republic of Kazakhstan

1. General provisions

1. The Ministry of Agriculture of the Republic of Kazakhstan - the central executive body performing management in regulated spheres namely, in the field of agro-industrial complex, agricultural industry, agriculture, seed farming and regulation of the market of grain, cotton industry, the state support of compulsory insurance in crop production, protection and quarantine of plants, veterinary science, processing industry regarding production of foodstuff, including drinks (except alcoholic products and ethyl alcohol), hardware of agro-industrial complex, livestock production, melioration, irrigation and drainage, agricultural science; in the field of state regulation of biofuel production, and also in limits, stipulated by the legislation, cross-industry coordination of state bodies in the field of the activities referred to its competence (further - the regulated sphere).

2. The Ministry of Agriculture of the Republic of Kazakhstan has departments:

1) public institution "Committee of veterinary control and supervision of the Ministry of Agriculture of the Republic of Kazakhstan";

2) public institution "Committee of the state inspection in agro-industrial complex of the Ministry of Agriculture of the Republic of Kazakhstan".

3. The Ministry of Agriculture of the Republic of Kazakhstan performs the activities according to the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

4. The Ministry of Agriculture of the Republic of Kazakhstan is legal entity in form of business of public institution, has seals and stamps with the name in state language, forms of the established sample, according to the legislation of the Republic of Kazakhstan of the account in bodies of treasury.

5. The Ministry of Agriculture of the Republic of Kazakhstan enters the civil relations from own name.

6. The Ministry of Agriculture of the Republic of Kazakhstan has the right to act as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation.

7. The Ministry of Agriculture of the Republic of Kazakhstan concerning the competence of the procedure established by the legislation makes the decisions which are drawn up by orders of the Minister of Agriculture of the Republic of Kazakhstan and other acts, stipulated by the legislation the Republic of Kazakhstan.

8. The limit of the number of staff of the Ministry of Agriculture of the Republic of Kazakhstan affirms the Government of the Republic of Kazakhstan.

The structure of the Ministry of Agriculture of the Republic of Kazakhstan affirms according to the current legislation of the Republic of Kazakhstan.

9. Location of the Ministry of Agriculture of the Republic of Kazakhstan: 010000, city of Astana, area Saryarka, Ulitsa Kenesary, 36.

10. Full name of state body - Public institution "Ministry of Agriculture of the Republic of Kazakhstan".

2. Mission, main objectives, functions, rights and obligations of the Ministry of Agriculture of the Republic of Kazakhstan

14. The mission of the Ministry of Agriculture of the Republic Kazakhstansozdany competitive agro-industrial complex by effective forming and realization of policy of the state in agro-industrial complex.

15. The main objectives of the Ministry of Agriculture of the Republic of Kazakhstan are:

1) forming of agrarian policy of the state, strategic plans, state and other programs and projects in regulated spheres;

2) forming of bases of creation of competitive agricultural commodity production, ensuring food security and mobilization readiness of the Republic of Kazakhstan;

3) information and consulting providing agro-industrial complex;

4) implementation of cross-industry coordination and public administration in regulated spheres;

5) implementation of methodical management of activities of other state bodies within the competence;

6) implementation of other tasks assigned to the Ministry of Agriculture of the Republic of Kazakhstan within the competence.

16. Functions of central office.

Central office:

1) creates state policy in the area:

agro-industrial complex;

grain market;

quarantine of plants;

cotton industry;

2) is performed by international cooperation in the area:

breeding livestock production;

quarantine and protection of plants;

beekeepings;

seed farmings;

safety of the food products which are subject to veterinary health control and supervision;

safety of machines and equipment;

3) develops industry development programs of breeding livestock production, industry programs of preserving and use of gene pool of breeding animals, including with limited gene pool;

4) performs development of the state scientific and technical programs in the field of breeding livestock production;

5) performs development of systems of information support in the field of breeding livestock production;

6) performs development of the instruction on appraisal of quality, assessment of breeding value and to reproduction of animals;

7) performs development of techniques and technical means for assessment and genetic control of breeding products (material);

8) approves instructions on appraisal of quality, assessment of breeding value and reproduction of animals;

9) is approved by the standard of breed;

10) develops the minimum indicators of assessment of the breeding plants, breeding farms and breeding loud-speakers;

Develops 11) and approves within the competence regulatory legal acts concerning carrying out testing and approbations of selection achievements in the field of livestock production;

12) develops forms of breeding certificates on all types of breeding products (material) and procedure for their issue;

13) is developed by procedure for assignment of the status of breeding animal;

Develops 14) and approves regulations on the Chief state inspector on breeding livestock production of the Republic of Kazakhstan and the state inspectors on breeding livestock production;

Develops 15) and approves forms of acts of the state inspector on breeding livestock production, procedure for their creation and issue;

Develops 16) and approves rules of maintaining the breeding book;

Develops 17) and approves rules of maintaining the state register of breeding animals;

Develops 18) and approves regulations on procedure for recognition of the breeding certificate or the document equivalent to it issued on the imported breeding products (material) by competent authorities of exporting countries and performs its recognition;

19) develops forms of accounting of breeding products (material) on livestock production industries;

Develops 20) and approves the list of breeds of the animals who are subject to subsidizing in priority procedure for the purpose of ensuring availability of breeding products (material) to domestic agricultural producers;

21) is developed by procedure for use by physical persons and legal entities of the breeding animals acquired at the expense of budgetary funds within development programs of breeding livestock production, preserving and use of gene pool of breeding animals including with limited gene pool;

Develops 22) and approves procedure for maintaining information base of selection and breeding work;

23) develops standard rates of subsidies for each type of breeding products (material);

24) is developed by procedure for subsidizing according to development programs of breeding livestock production;

Will organize 25), coordinates and controls carrying out applied scientific research in the field of quarantine of plants;

26) approves regulations on the state inspectors of quarantine of plants;

27) develops rules on withdrawal and destruction of the quarantine products infected with quarantine objects, which are not subject to disinfecting or conversion;

28) develops the phytosanitary requirements imposed to the imported quarantine products;

29) is developed by the list of quarantine products;

30) develops together with the research organizations quarantine measures on the basis of scientific valuation principles of phytosanitary risk taking into account requirements of the international standards and recommendations;

31) the list of the officials having the right to wearing uniform (without shoulder strap) determines, uniform samples (without shoulder strap) and procedure for carrying;

32) provides within the competence protection of the data constituting the state secrets and also information classified by them;

33) develops programs for the organization of leasing of agricultural machinery and the equipment, development of selection and seed farming, technology of cultivation of grain crops, preserving fertility of soils, protection and quarantine of plants;

34) develops offers on application of anti-dumping measures in protection of producers of grain;

35) develops the qualification requirements imposed to activities for rendering services in warehouse activities with issue of grain receipts;

36) approves instruction forms of elimination of violation of requirements of the legislation of the Republic of Kazakhstan of grain, the protocol on administrative offense, the resolution on the case of administrative offense;

37) develops requirements to procedure for examination of quality of grain and issue of the quality certificate of grain;

38) develops technical regulations of grain and processes of its lifecycle;

39) develops rules of conducting quantitative and high-quality accounting of grain;

40) develops grain storage precautions;

41) develops rules of issue, the address and repayment of grain receipts;

42) develops rules of carrying out temporary management of the cereal-receiving company;

43) develops rules of use of system of electronic grain receipts;

Develops 44) and approves rules of carrying out monitoring of the grain market;

Develops 45) and approves regulations on the state grain inspectors;

Develops 46) and approves standard forms of the reporting of the cereal-receiving companies;

47) develops requirements to forms on which the grain receipt, procedure for their release, acquisition, storage and destruction, and also the requirement to sample of grain receipts is written out;

Develops 48) and approves forms of the act of inspection of the cereal-receiving company;

Develops 49) and approves by areas quota of purchase of grain in the state resources of grain;

Develops 50) and approves standard forms of the delivery agreement of grain in the state resources of grain between the agent and domestic manufacturer of grain, and also the agent and the exporter of grain;

Develops 51) and approves standard forms of the delivery agreement of grain from the state realizable and state stabilization resources of grain for the purpose of regulation of the domestic market between the agent and the grain processing organization;

Develops 52) and approves standard forms of the agreement of realization of the flour made from grain of the state realizable and state stabilization resources of grain between the grain processing and baking organizations;

Develops 53) and approves confirmation forms of observance by the exporter of grain of obligations on supply of grain to the state resources of grain and its issue to the exporter of grain;

54) develops standard forms of public contracts between the cereal-receiving company and the owner of grain;

55) the procedure for receipt of guarantees of fund (funds) for guaranteeing obligation fulfillment for grain receipts, procedure for repayment of obligations according to grain receipts fund (funds) of guaranteeing obligation fulfillment for grain receipts develops requirements to creation, functioning and liquidation of funds of guaranteeing obligation fulfillment for grain receipts, conditions of participation of the cereal-receiving companies in system of guaranteeing obligation fulfillment on grain receipts;

56) will organize development of industry development programs of beekeeping;

57) performs the organization of the scientific research directed to protection and reproduction of bees;

58) is approved by the plan of pedigree division into districts of bees in the Republic of Kazakhstan;

59) is approved by the list of remedies of the plants, mineral fertilizers and other medicines applied to processing of melliferous plants;

Develops 60) and represents to the Government of the Republic of Kazakhstan programs in the field of protection of plants;

Develops 61) and represents the list of especially dangerous harmful organisms to the Government of the Republic of Kazakhstan;

Will organize 62) and coordinates implementation of orders for applied scientific research in the field of protection of plants;

Will organize 63), coordinates and controls carrying out applied scientific research in the field of protection of plants, approves the methods developed as a result of researches, techniques, recommendations regulating procedure and methods of implementation of phytosanitary actions;

64) develops technical regulations in the field of turnover of pesticides (agricultural chemicals);

65) develops the qualification requirements imposed to activities for production (formulyation) of pesticides (agricultural chemicals), realization of pesticides (agricultural chemicals), use of pesticides (agricultural chemicals) aerosol and fumigatsionny by methods;

66) develops rules of carrying out registration, production testing and state registration of pesticides (agricultural chemicals);

Develops 67) and approves the list of pesticides (agricultural chemicals);

68) approves recommendations and methodical instructions for implementation of phytosanitary actions;

69) approves forms of protocols and instructions, and also procedure for their creation and removal according to the legislation of the Republic of Kazakhstan in the field of protection of plants;

70) develops phytosanitary standard rates, forms of phytosanitary accounting, and also procedure for their representation;

71) develops statistical methodology on departmental statistical observations;

72) approves the methods, techniques, recommendations regulating procedure, methods of implementation of phytosanitary actions organizes, coordinates and controls carrying out applied scientific research in the field of protection of plants, and also approves the training program (training programs) on preparation and advanced training of specialists in protection of plants;
