About modification and amendments in the Civil code of the Kyrgyz Republic

Article 1. Bring in parts I and II of the Civil code of the Kyrgyz Republic (Sheets of Jogorku Kenesh of the Kyrgyz Republic of 1996, No. 6, Art. 80 and 1998 of, No. 6, the Art. 226) the following changes and amendment:
1. In article 309 of part I of the Code of the word "in the absence of other agreement" to exclude.
2. To add article 726 of part II of the Code with Item 5 of the following content:
"5. In case of the return ahead of schedule loan amounts provided under percent according to Item 2 of article 727 of this Code, percent are charged inclusive about day of early return of loan amount completely or its parts.".
3. To state Item 2 of Article 727 in the following edition:
"2. If other is not provided by the loan agreement, the amount of non-interest loan can be returned by the borrower ahead of schedule.
The loan amount, provided under percent to physical persons and legal entities, except for professional participants of the financial market, can be returned by physical persons and legal entities ahead of schedule completely or in parts on condition of the notification on it of the creditor at least in thirty days prior to day of such return. By the loan agreement shorter time for notification of the creditor about intention of the borrower to return money ahead of schedule can be established.
The loan amount, provided under percent, in other cases can be returned ahead of schedule with the consent of the creditor.".
Article 2. Action of provisions of Item 5 of Article 726 and Item 2 of article 727 of part II of the Code extends to the relations which arose from loan agreements of credit agreements signed about day of entry into force of this Law.
Article 3. This Law becomes effective from the date of official publication.
