Concerning features of implementation of the international motor transportations in/from the Republic of Moldova
For the purpose of avoidance of cases of groundless detention at check points through frontier of Ukraine of automotive vehicles which carry out the international motor transportations of loads in/from the Republic of Moldova, report that according to information provided by the Ministry of infrastructure of Ukraine, transportation of passengers and loads between Ukraine and the Republic of Moldova is regulated by regulations of the Agreement between the Government of Ukraine and the Government of the Republic of Moldova on the international motor transportations (further - the Agreement) which is made in Chisinau on March 20, 1993.
According to article 9 of the Agreement transportation of goods by vehicles of one of the Contractual Parties when the point of departure and destination is in the territory of the second Contractual Party or when the point of departure is in the territory of the second Contractual Party, and destination in the territory of the third country, is not allowed. However competent authorities of the Contractual Parties can grant permission for implementation of such transportations in each separate case.
According to article 11 of the Agreement the organizational, technical and business concerns connected with implementation of automobile communication on the basis of this Agreement will be settled in bilateral protocols and agreements which are signed between competent authorities of the Contractual Parties.
In particular, according to the Minutes of the Mixed Ukrainian-Moldavian Commission on questions of the international motor transportations (Chisinau, 18-20.03.2003) parties agreed that the permissions in/from the third countries issued by competent authority of the second Contractual Party will be valid for implementation of the following transportations from load in both directions:
- the third country - the second Contractual Party - the third country;
- the third country - the second Contractual Party - country of incorporation;
- country of incorporation - the second Contractual Party - the third country.
