Article 1

"Article 45. Bases of the termination of the right of permanent (termless) use of the parcel of land, rights of lifetime inheritable possession parcel of land

1. The right of permanent (termless) use of the parcel of land, right of lifetime inheritable possession of the parcel of land stop in case of refusal of the land user, land owner of the right to the parcel of land belonging to them on conditions and according to the procedure which are stipulated in Article 53 of this Code.

1) in case of inadequate use of the parcel of land, namely in case of:

use of the parcel of land with gross violation of rules of rational use of the earth including if the site is used not according to its purpose or its use leads to essential decrease in fertility of farmlands or considerable deterioration in ecological situation;

to spoil of lands;

failure in duty on recultivation of lands, obligatory actions for improvement of lands and protection of soils;

failure in duty on reduction of lands in the condition suitable for use on purpose;
