About introduction of amendments to some laws of Ukraine concerning enhancement of procedure for state registration of the corporeal rights to the parcels of land of the state-owned and utility property in connection with their differentiation

The Verkhovna Rada of Ukraine decides:

I. Make changes in such to the laws of Ukraine:

1. In the Law of Ukraine "About state registration of the corporeal rights to real estate and their burdenings" (Sheets of the Verkhovna Rada of Ukraine, 2010, No. 18, Art. 141; 2012, No. 8, Art. 61; with the changes made by the laws of Ukraine of July 4, 2012 No. 5037-VI of September 6, 2012 No. 5206-VI and of October 16, 2012 No. 5461-VI):

Part the sixth Article 3 to add 1) with words and figures "and article 4-1 of this Law";

Part the second Article 4 to add 2) with words and figures "except cases, the stipulated in Article 4-1 this Law";

To add 3) with Article 4-1 of such content:

"Article 4-1. Features of state registration of the corporeal rights to the parcels of land of the state-owned and utility property

1. The decision of executive bodies or local government bodies on transfer of the parcels of land to property or use (permanent use, lease, use of the parcel of land for agricultural requirements (emphyteusis), use of others parcel of land for building (superficies), the servitude) is accepted without implementation of state registration of the right of the state or territorial society on such parcels of land, except cases when the property right to the parcels of land of the state-owned or utility property is already registered in the State register of the corporeal rights to real estate.

2. In case of sale of the parcels of land of the state-owned or utility property or the rights to them (leases, superficies, emphyteusis) at the land biddings state registration of the right of the state or territorial society on them is performed after approval according to the procedure, established by the Land code of Ukraine, documentation on land management according to which their forming, before carrying out such land biddings is performed.
