About modification in Criminal and Criminal procedural codes of Ukraine concerning accomplishment of the Action plan concerning liberalization of visa regime by the European Union for Ukraine

I. Introduce in Criminal and Criminal procedural codes of Ukraine such changes:

1. In the Criminal code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2001 No. 2526, the Art. 131):

The name of the Section XIV of the General part to state 1) in such edition:

"Other actions of criminal and legal nature";

To add 2) with Articles 96-1 and 96-2 of such content:

"Article 96-1. Special confiscation

1. Special confiscation consists in forced free withdrawal by a court decision in property of the state of money, values and other property on condition of crime execution in the cases provided in the Special part of this Code.

Article 96-2. Cases of application of special confiscation

1. Special confiscation is applied if money, values and other property:

1) are received as a result of crime execution and/or are the income from such property;

2) intended financings and/or material security of crime or remuneration for its making (were used) for inducement of person to crime execution;

3) were crime subject, except those which return to the owner (legal owner) and in case it is not established, - the states carry over;

4) were found, made, adapted or used as means or the tool of crime execution, except those which return to the owner (legal owner) who did not know and could not know about their illegal use.
