About modification of some legal acts of Ukraine concerning elimination of restrictions in carrying out economic activity

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Code of administrative legal proceedings of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2005, Art. No. No. 35-37, 446):

Part the second Article 18 to add 1) with Item 3 of such content:

"3) concerning confirmation of justification of application by subjects of powers of authority of response measures during implementation of the state supervision (control) in the field of economic activity";

The Section III to add 2) with Article 183-6 of such content:

"Article 183-6. Features of production for relatively confirmation of justification of application by subjects of powers of authority of response measures during implementation of the state supervision (control) in the field of economic activity

1. Production for relatively confirmation of justification of application by subjects of powers of authority of responses to the violations of requirements of the legislation revealed during implementation of the state supervision (control) in the field of economic activity if need of such confirmation is provided by the law, is performed based on the administrative claim of the subject of powers of authority which applies adequate measures of reaction.

2. Administrative claim is submitted by the subject of powers of authority to district administrative court not later than the next day from the date of the edition (acceptance) of the relevant ordering document on reaction taking measures which justification is subject to confirmation by court.

3. The action for declaration shall meet the requirements, stipulated in Clause the 106th of this Code. If violation which became the basis for reaction taking measures was revealed by appropriate subject of powers of authority during conducting check, copies of documents which confirm observance of the procedure of conducting this check are enclosed to the action for declaration.
