About protective measures, the anti-dumping and compensatory duties
The purpose of this Law is regulation of the relations in scope of protective measures, the anti-dumping and compensatory duties in case of commodity import for elimination of serious damage or threat of causing serious damage of industry of economy.
The legislation on protective measures, the anti-dumping and compensatory duties consists of this Law and other acts of the legislation.
If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about protective measures, the anti-dumping and compensatory duties then are applied rules of the international treaty.
In this Law the following basic concepts are applied:
economy industry - set of all producers of the Republic of Uzbekistan of similar goods or that from them which share constitutes the main part in the total production of such goods in Uzbekistan;
serious damage of industry of economy - essential deterioration in production, trade and financial performance of industry of economy or essential delay in formation of industry of economy which stepped owing to the increased commodity import, commodity import on dumping prices or import of the subsidized goods on customs area of the Republic of Uzbekistan;
threat of causing serious damage of industry the ekonomikineizbezhnost of causing serious damage of industry of economy confirmed with proofs;
the regular course of trade - purchase and sale of goods in the domestic market of the manufacturing country or exporting country at the price which consists of its weighted average cost and average profit margin or of the comparable prices of the similar goods imported to the Republic of Uzbekistan from the third country which is in similar conditions;
