According to the Convention on the transfer of persons suffering from mental disturbances, for performing forced treatment, signed in the city of Moscow on March 28, 1997 (further - the Convention), this Federal Law determines procedure for transfer by the Russian Federation to foreign state - to the participant of the Convention and procedure for acceptance by the Russian Federation from foreign state - the participant of the Convention of person suffering from mental disturbance concerning which there is judgment which took legal effect about application of enforcement powers of medical nature.
For the purposes of this Federal Law the following basic concepts are used:
1) person suffering from mental disturbance - the citizen of the Russian Federation or the person without citizenship who is constantly living in the Russian Federation, the citizen of foreign state - the participant of the Convention or the person without citizenship who is constantly living in foreign state - the participant of the Convention which made socially dangerous (penal) act in condition of diminished responsibility and concerning which there is decision which took legal effect according to court of foreign state - the participant of the Convention, court of the Russian Federation about application of enforcement powers of medical nature;
2) legal representatives of person suffering from mental disturbance - parents, adoptive parents, guardians or custodians of person suffering from mental disturbance, representatives of the organization in which this person undergoes forced treatment, guardianship and custody bodies;
