About introduction of amendments to the Law of Ukraine "About production sharing agreements" rather state regulation of the conclusion and agreement performance

The Verkhovna Rada of Ukraine decides:

I. Bring in the Law of Ukraine "About production sharing agreements" (Sheets of the Verkhovna Rada of Ukraine, 1999, No. 44, Art. 391; 2011, No. 6, Art. 47; 2012, No. 5, Art. 31, No. 27, Art. 275; with the changes made by the laws of Ukraine of October 2, 2012 No. 5406-VI and of October 16, 2012 No. 5463VI) such changes:

1. The second Article 3 to add part with the words "and taking into account provisions of this Law".

2. In Article 5:

Part one to state 1) in such edition:

"1. The investor (investors) and the state on behalf of the Cabinet of Ministers of Ukraine act as agreement parties about the Section of products.

For the solution of questions on the organization of the conclusion and agreement performance of the Section of products the Cabinet of Ministers of Ukraine forms the permanent interdepartmental commission (the dalshemezhvedomstvenny commission) as a part of representatives of state bodies, local government bodies, People's Deputies of Ukraine.

Information, organizational, material and other support of activities of the Interdepartmental commission performs the central executive body (further - working body of the Interdepartmental commission) determined by the Cabinet of Ministers of Ukraine.

The regulations on the Interdepartmental commission affirm the Cabinet of Ministers of Ukraine";

2) to include part the second such content:

"2. The solution of questions on management and coordination of activities of the parties can be assigned by the production sharing agreement to the steering committee or other governing body created with participation of the parties.

For the purpose of participation of the state in accomplishment of the signed production sharing agreement (including participations in activities of the created governing bodies) the Cabinet of Ministers of Ukraine can confer necessary powers to the central executive body".
