About the List of the documents submitted to customs authorities for release of imported goods from the tax discharge on value added and customs duties

According to Item 8 of Article 345 of the Customs code of the Republic of Tajikistan, part 5 of article 315 of the Tax Code of the Republic of Tajikistan and article 51 of the Law of the Republic of Tajikistan "About regulatory legal acts" the Government of the Republic of Tajikistan decides:

1. Determine that for release of goods, from the tax discharge on value added and customs duty imported on customs area of the Republic of Tajikistan for performance of works according to the Law of the Republic of Tajikistan "About production sharing agreements" it is necessary to submit customs authority the following documents:

- the copy of the production sharing agreement between the Government of the Republic of Tajikistan and the investor;

- business documents of imported goods;

- letter obligation of the investor on target use of imported goods;

- transport (transportation) documents;

- the inventory (on each imported batch) for performance of works according to working programs and. expense budgets which are approved by the investor or operating company (operator) of the production sharing agreement;

- the copy of the contracts on commodity importation approved according to working programs and expense budgets the investor or operating company (operator) of the production sharing agreement.

2. Declare invalid the order of the Government of the Republic of Tajikistan of September 20, 2008, No. 455 "About approval of the List of documents which according to production sharing agreements are the basis for exemption of the value added tax and customs duty of imported goods".
