Rules of conducting medico-social examination

1. General provisions

1. These rules of conducting medico-social examination (further - Rules) are developed according to the Laws of the Republic of Kazakhstan of June 16, 1997 "About the public social benefits on disability, on the occasion of loss of the supporter and on age in the Republic of Kazakhstan", of April 25, 2003 "About compulsory social insurance", of February 7, 2005 "About compulsory insurance of the worker from accidents in case of execution of labor (office) obligations by it", of April 13, 2005 "About social protection of disabled people in the Republic of Kazakhstan" and regulate procedure for establishment of disability and extent of disability, and also determination of needs of osvidetelstvuyemy person for measures of social protection.

2. Establishment of disability and extent of disability, and also determination of needs of osvidetelstvuyemy person for measures of social protection are carried out by conducting medico-social examination (further - MSE) departments of medico-social examination and/or methodology and control of medico-social examination of territorial subdivisions of Committee on control and social protection of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan.

3. In these rules the following concepts are used:

1) qualification - degree of professional readiness of the worker, availability at it of knowledge, skills necessary for accomplishment of certain degree of complexity of work;

2) working capacity - capability to perform activities according to requirements to content, amount and conditions of performance of work;

3) disability - loss by the worker of capability to perform work, to render services which extent is expressed as a percentage of the lost working capacity (further - loss of general working capacity);

4) profession - sort of labor activity (occupations) of the person owning complex of the special theoretical knowledge and practical skills acquired as a result of special preparation and work experience;

5) occupational disease - the chronic or acute disease caused by impact on the worker of harmful production factors in connection with accomplishment by the worker of the labor (office) obligations;

6) professional working capacity - employee ability to performance of work of certain qualification, amount and quality;

7) extent of loss of professional working capacity (further - UPT degree) the level of decline in the ability of the worker to carry out labor (office) obligations;

8) survey - carrying out MSE with determination and accounting of rehabilitation potential and the forecast;

9) osvidetelstvuyemy person - person concerning whom MSE is carried out;

10) medico-social examination - determination in accordance with the established procedure needs of osvidetelstvuyemy person for measures of social protection, on the basis of assessment of the restrictions of life activity caused by permanent disorder of functions of organism;

11) department of methodology and control MSE - the department of territorial subdivision of Committee on control and social protection of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan performing methodology and control concerning MSE;

12) department of MSE - department of territorial subdivision of Committee on control and social protection of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of carrying out MSE. Depending on level, structure of incidence and disability departments of MSE are subdivided into departments of MSE of general profile, specialized profile (for survey (re-examination) of TB patients, persons with mental disturbances) and pediatric profile;

13) the disabled person - person having the violation of health with permanent disorder of functions of organism caused by diseases, injuries, their effects, defects which leads to restriction of life activity and need of its social protection;

14) the handicapped child - person aged up to eighteen years having the violation of health with permanent disorder of functions of organism caused by diseases, injuries, their effects, defects, leading to restriction of life activity and need of its social protection;

15) the individual program of rehabilitation of the disabled person (further - the International Party of Russia) - the document determining specific amounts, types and terms of carrying out rehabilitation of the disabled person;

16) disability - extent of restriction of life activity of the person owing to violation of health with permanent disorder of functions of organism;

17) social protection of disabled people - package of measures for the public assistance, rehabilitation, and also integration of disabled people into society;

18) rehabilitation of disabled people - complex of the medical, social and professional actions directed to elimination or perhaps total compensation of the restrictions of life activity caused by violation of health with permanent disorder of functions of organism;
