Chapter I. General provisions

Article 1. Purpose and scope of application

1. The purpose of this Model law (further - the Law) is protection of economic interests of producers of goods in the State Parties of the CIS in connection with the increased import, dumped imports or subsidized import on customs area of the State Party of the CIS.

2. The law establishes procedure for introduction and application of the special protective, anti-dumping and countervailing measures in case of commodity importation declared in customs regime of release for free circulation in the territory of the State Party of the CIS.

3. The law does not govern the relations connected with rendering services, performance of works, transfer of exclusive rights on intellectual property items or provision of the right to use intellectual property items; implementation of investments and currency exchange control.

Article 2. The basic concepts used in the Law

For the purposes of the Law the following basic concepts are used:

anti-dumping duty - duty which is established over rate of customs duty on import of dumping goods;

anti-dumping trial - the procedure of consideration of documents concerning deliveries of the goods realized at the price is lower than its normal cost if such realization causes material damage or creates threat of its drawing to the domestic manufacturers making similar goods;

anti-dumping measures - set of the means of administrative and economic impact applied to import of dumping goods in the form of temporary anti-dumping measures, anti-dumping duties or price obligations for elimination of material damage or threat of its drawing to domestic manufacturers of similar goods;
