About organ transplantation and (or) tissues of the person

This Law determines legal and organizational bases of organ transplantation and (or) tissues of the person and is directed to public health care.

Article 1. Basic concepts

In this Law the following basic concepts are used:

1) organ transplantation and (or) tissues of the person - substitution at the recipient by surgery of the absent or damaged bodies and (or) fabrics not capable to provide life activity of the person, bodies and (or) tissues of the living donor or posthumous donor (further – transplantation);

2) organs harvesting and (or) tissues of the person - withdrawal by surgery of bodies and (or) fabrics at the living donor or the posthumous donor and their immunological research, preservation and storage;

3) bodies and (or) tissues of the person - the anatomic educations (the whole bodies, fragments of bodies, combinations of cages, separate cages) which are not determining distinctive features of the personality;

4) the living donor - person who voluntarily agreed in accordance with the established procedure to fence of the bodies and (or) fabrics for transplantation to the recipient;

5) the posthumous donor - body of the person at which after death organs harvesting and (or) fabrics for transplantation to the recipient is carried out;

6) death – the irreversible termination of activities of brain of the person (brain death) in case of which it is artificial by means of medicines and medical equipment can temporarily be supported its warm activities and breath;

7) the recipient – person to whom transplantation is performed.

Article 2. Legislation of Turkmenistan on transplantation

1. The legislation of Turkmenistan on transplantation is based on the Constitution of Turkmenistan and consists of this Law and other regulatory legal acts of Turkmenistan in the field of transplantation.

2. If the international treaty of Turkmenistan establishes other rules than containing in this Law, then rules of the international treaty are applied.
