About modification and amendments in the Law on diplomatic service of December 27, 2001 No. 761-XV

Art. I. - In the Law on diplomatic service No. 761-XV of December 27, 2001 (Official monitor of the Republic of Moldova, 2002, No. 20, of the Art. 80), with subsequent changes, to make the following changes and additions:

1. State Article 2 in the following edition:

"Article 2. Diplomatic service

For the purposes of this law the diplomatic service is understood as set of diplomatic and consular establishments of the Republic of Moldova, and also their activities for the purpose of realization of the purposes delivered before them according to this law.".

2. In Article 3:

"a) implementation of foreign policy of the Republic of Moldova and participation in promotion of its economic interests;";

For the purpose of check of procedure by diplomatic representations and consular establishments of the Republic of Moldova of the functions, the organization of their activities and use of technical, material and financial resources by them, and also for the purpose of control of observance by these organizations of orders of organizational nature, the office regulations, acts of the labor law and other regulations including concerning living conditions of their personnel, the Minister of Foreign Affairs and European Integration can on own initiative or upon the demand of competent organizations or the member of personnel of organizations of diplomatic service to dispose about inspection of diplomatic representations and consular establishments. Inspection of diplomatic representations and consular establishments is performed by service of internal audit, if necessary - together with other specialists of the Ministry of Foreign Affairs and European Integration.".

7. In Article 9:

in part (1):

1) to add Item with subitems and 1) and and 2) the following content:

"and 1) from responsible state officials on diplomatic positions;

and 2) from personnel of office of the minister;";

2) to state Item in the following edition:

"2) as a part of diplomatic representations and consular establishments:

a) from the government employees holding diplomatic and consular positions (further - respectively diplomatic agents and consular officials);

b) from the government employees who are not holding diplomatic and consular positions;

c) from administrative and technical and service personnel.";

add Article with parts (11), (12) and (13) the following content:

"(11) the Members of personnel of organizations of diplomatic service enlisted to diplomatic and consular positions are government employees with special status, except for responsible state officials and personnel of office of the minister.

(12) as a part of organizations of diplomatic service are effective:

a) career diplomats are government employees with special status who are taken on staff of organizations of diplomatic service of the Republic of Moldova, have diplomatic ranks and are authorized to represent the Republic of Moldova in the international relations;

b) specialists diplomats are government employees with special status who are delegated by national authorities or organizations for implementation of activities in diplomatic representations or consular establishments of the Republic of Moldova, are authorized to represent the Republic of Moldova in the international relations and which powers are limited to certain field of activity.
