About modification of some legal acts of Ukraine concerning enhancement of system of personal data protection

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. In the Code of Ukraine about administrative offenses (The sheet of the Supreme Council of USSR, 1984, appendix to No. 51, the Art. 1122):

1) in Article 188-19:

in the name of the word of "The representative of the Verkhovna Rada of Ukraine for human rights" to exclude;

the paragraph one to state in such edition:

"Failure to carry out of legal requirements of Audit Chamber or creation of obstacles in its work, or provision of obviously inveracious information by it, and also non-compliance with the terms of provision of information established by the legislation to the People's Deputy of Ukraine, Audit Chamber";

The text of Article 188-39 to state 2) in such edition:

"Not message or the untimely message to the Representative of the Verkhovna Rada of Ukraine for human rights about processing of personal data or about change of data which are subject to the message according to the law, the message of incomplete or false information -

involve imposing of penalty on citizens from hundred to two hundred tax-free minima income of citizens and on officials, citizens - subjects of business activity - from two hundred to four hundred tax-free minima income of citizens.

Failure to carry out of legal requirements (instructions) of the Representative of the Verkhovna Rada of Ukraine for human rights or the officials of the secretariat of the Representative of the Verkhovna Rada of Ukraine for human rights determined by it concerning prevention or elimination of violations of the law about personal data protection -

involve imposing of penalty on citizens from two hundred to three hundred tax-free minima income of citizens and on officials, citizens - subjects of business activity - from three hundred to one thousand tax-free minima of the income of citizens.

Making of violation, repeated throughout year, from among provided by parts one or the second this Article for which person was already subjected to administrative punishment, -
