About zones of ecological catastrophe (about the status of zones of ecological catastrophe and regulation of economic and other activity in their territory)

This Law governs the relations in the field of giving to the separate territories of the state of the status of zone of ecological catastrophe and their conclusion from this condition for the purpose of ensuring constitutional rights of citizens on the favorable environment and public health care.

Reference of the territories to zones of emergency ecological situation and ecological disaster is performed for the purpose of determination of sources and factors of deterioration in ecological situation and development of reasonable urgent measures for stabilization and decrease in degree of ecological trouble, decrease in level of impact of economic and other activity on the environment, carrying out operational measures for recovery of natural resources and minimization of effects for the state of health of the population.

Chapter 1. General provisions

Article 1. Basic concepts

For the purposes of this Law the following basic concepts are used:

admissible impact on the environment - the impact providing acceptable quality of the environment;

zone of ecological catastrophe - the site of the territory where as a result of economic or other activity there were profound irreversible changes of the environment which entailed essential deterioration in health of the population, violation of natural balance, destruction of natural ecological systems, degradation of flora and fauna;

criteria of ecological disaster - indicators of state of environment and health of the population which are the basis for giving to the separate territories of the state of the status of zones of ecological catastrophe;

risk assessment for health of the population - process of establishment of probability of development and degree of expressiveness of adverse effects for health and the life of the population caused by environmental pollution;

risk for health of the population - the probability of threat of life or to health of the population or threat of life or health of future generations caused by impact of factors of the habitat;

sanitary and epidemiologic examination - activities of bodies and organizations of the public sanitary and epidemiologic service, the organizations accredited in accordance with the established procedure, and experts in establishment of compliance (discrepancy) of project and other documentation, objects of economic and other activity, products, works, services to sanitary and epidemiologic safety requirements (technical regulations) and health regulations, stipulated by the legislation the states;

the subject of ecological danger - legal entity or physical person, including the official whose activities can create ecologically dangerous situation;

essential deterioration in health of the population - increase in violations of health, changes of structure of causes of death and emergence of the specific diseases, irreversible, not compatible to life, caused by environmental pollution and also essential increase in frequency of the reversible violations of health connected with environmental pollution;

health hazard of the population - increase in frequency of the reversible violations of health connected with environmental pollution;

steady state of environment:

a) concerning objects of animal and flora - capability of objects of animal and flora in the long term to reproduce itself as viable component of the native habitat, availability of the native habitat of objects of animal and flora necessary for their preserving in the long term;

b) concerning natural and natural and anthropogenous complexes - stability in the long term of processes and the relations of the natural and natural and anthropogenous complexes providing their functioning;

ecological disaster - the ecological situation which arose on the site of the territory where as a result of economic and other activity or natural natural processes there were profound irreversible changes of the environment which entailed essential deterioration in health of the population, destruction of natural ecological systems, deterioration in condition of animal and flora.
