About transport activities

This Law governs the public relations reflecting the most general provisions about transport activities, is aimed at the development of the market relations in the field of transport activities and creation of conditions for integration of subjects of transport activities of the state into the international market of transport works and services.

Chapter 1. General provisions

Article 1. Coverage of this Law

1. This Law extends to the relations arising when implementing any transport activities made on commercial basis.

2. The transport activities performed for the purpose of ensuring defense capability, safety, law and order and health protection are regulated by other acts of the national legal system.

Article 2. Legislation on transport activities

1. Transport activities are regulated by this Law, and also:

- regulations of the civil legislation on the contractual and property relations, transportation, transport expedition as to the legal basis of the civil relations in transport activities;

- the legislation on transport and the legislation on modes of transport: about railway, automobile, water (internal and sea), air and pipeline transport, and also transport codes;

- the legislation governing the relations of users of transport infrastructure;

- the legislation governing the relations which are directly connected with rendering services in course of carriage (about forwarding activities, transportation insurance, traffic safety, customs and currency control of international carriages, the taxation and others);

- the legislation governing the relations connected with transportation of goods and passengers in through mixed traffic (about transport corridor, the transport operator, end-to-end rate, the information and logistic center, the reloading terminal, etc.);

- international agreements and conventions in the field of transport;

- the legislation regulating questions of transport safety.

2. This Law can be basis of system of the national legal system in the field of transport activities.

Article 3. Basic concepts and their determinations

In this Law the following concepts are used:

baggage - the passenger's things accepted in accordance with the established procedure for transportation in the vehicle intended for transportation of passengers to the destination specified in the travel document (ticket);

the owner of transport infrastructure - the legal entity or the individual entrepreneur having infrastructure on the property right or other right and rendering services in its use based on the relevant agreement and (in case of need) the license;

foreign trade activity - business activity in the field of the international exchange of goods, works, services, information, and also results of intellectual activities and exclusive rights on them (intellectual property);

internal transportation - transportation of the goods shipped on customs area of one state and subjects to unloading in the territory of the same state;

load - the goods or other movable object (including products, objects, minerals, materials, raw materials, production wastes and consumption) accepted in accordance with the established procedure for transportation in cargo vehicles (places), containers;

cargo baggage - the object accepted from physical person or legal entity in accordance with the established procedure for transportation in the passenger, post and luggage or passenger-and-freight vehicle;

the consignor (sender) - the physical person or legal entity which according to the transportation agreement acts on its own behalf or on behalf of the owner of load, baggage, cargo baggage and is specified in the carriage document;

the consignee (receiver) - the physical person or legal entity authorized on receipt of load, baggage, cargo baggage;

intermodal transport - consecutive cargo hauling in the same unit load (large size container, demountable body, semitrailer truck, etc.) with its transfer along the line from one mode of transport on another without overload of the load;
