About professional sport
This Law establishes legal, organizational and social basis of regulation of the public relations in the field of professional sport, and also determines legal status of professional athletes, professional coaches and other sports workers.
In this Law the following basic concepts are used:
the state - the State Party of the Commonwealth of Independent States;
professional sport - professional sports activity of the physical person or legal entity participating in sports competitions for the purpose of achievement of high sports results and profit earning;
the professional athlete - physical person for which professional sports are core activity, the reward which signed the employment contract in the field of professional sport (the contract on sports activities) and earning (including the salary) for preparation for sports competitions, participation in them and the shown results;
the professional coach - the physical person who had special training and having the corresponding confirmation on the right to work at the basis of the employment or civil contract which execution provides carrying out with professional athletes of sports educational and training occupations, training in their safe and effective acceptances and methods of trainings for achievement of sports result, development of perspective, current and individual plans of training of the professional athlete and control of their execution;
the professional judge - the physical person having special qualification, authorized by the international sports federation, national sports federation, the professional sports organization or the organizer of sports competitions to provide observance of the corresponding rules and conditions of holding sports competitions, and also the reward for implementation of the specified activities earning in accordance with the established procedure;
other sports worker - the doctor, the massage therapist, the psychologist, and also the other person who signed the employment contract in the field of professional sport with professional sports club, directly involved in process of training of the professional athlete for sports competitions and its participations in them;
the international sports federation (association) - the international non-governmental organization recognized by the International Olympic Committee (IOC) managing one or several sports at the international level and combining the organizations managing this type (types) of sport at the national level in the structure;
the professional sports organization - properly accredited legal entity performing the organization, preparation and holding official sports competitions in separate type (or to types) sport within the state;
professional sports club - the legal entity created and who is acting by the legislation of the state, entered member or contractual relations with sports federation or the professional sports organization, participating in sports competitions and profiting from these activities;
national team of the state - the permanent or temporary group of athletes, trainers, doctors, scientists, other specialists and workers of physical culture and sport on certain sport created by sports federation and authorized body of the government of the country in the field of physical culture and sport for preparation and participation in sports competitions under national flag of certain state;
sports federation - the non-profit organization exercising control of type (types) of sport in the territory of the state, being the member of the relevant international sports federation recognized by the IOC, observing provisions of the Olympic Charter of the IOC, the charter and rules of the relevant international sports federation, and also recognized or being the member of National Olympic Committee of the country;
sports school - the specialized sports organization for children and young people performing training of professional athletes;
sports offense - illegal, guilty action or failure to act of physical person or legal entity for which regulations of the sports or civil legislation establish disciplinary (sports) responsibility;
sports competitions - set or separate events (competitions) in the field of professional sport held under the auspices of the international sports federations, national sports federations, the professional sports organizations and other organizations in playful or not playful way for the purpose of achievement of high sports results and clarification of benefit in degree of physical, psychophysiological or organizational fitness of certain professional athletes or their groups;
subjects of professional sport - authorized bodies of the government, sports federations, the professional sports organizations, professional sports clubs, sports schools, professional athletes, professional coaches, professional judges and other sports workers;
the employment contract in the field of professional sport (the contract on sports activities) - the written agreement (contract) between the professional athlete, the professional coach or other sports worker and professional sports club registered by sports federation according to which the professional athlete or other sports worker shall perform personally the labor function defined by this agreement, aim at achievement of high sports results and carry out other obligations provided by the agreement, and professional sports club shall for it pay to the professional athlete or other sports worker the salary in the amount of and procedure, defined by the agreement and to carry out other obligations provided by such agreement.
