Concerning representation of conclusions of Ministry for Protection of the Environment and Natural Resources to customs authorities about lack of ozone-depleting substances in goods we inform on the following.
According to provisions of Article 197 of the Customs code of Ukraine customs authorities control documents which confirm observance of restrictions concerning movement of separate types of goods through customs border of Ukraine and are issued by the state bodies or other legal entities authorized on their issue if submission of such documents to customs authorities is provided by the laws of Ukraine.
On accomplishment of Article 197 of the Customs code of Ukraine by the Cabinet of Ministers of Ukraine the resolution of 21.05.2012 No. 436 "About approval of inventories on which restriction concerning movement through customs border of Ukraine is set" is accepted. This resolution also determines the list of documents which are issued by the state bodies or other legal entities authorized on issue of these documents for representation to their customs authorities in case of the omission of goods through customs border of Ukraine and their customs clearance. The specified lists do not include, in particular, such document as conclusion of Ministry for Protection of the Environment and Natural Resources on lack of ozone-depleting substances in goods as the laws of Ukraine do not provide representation of this document to customs authorities.
Rather customs clearance of the goods included in appendix 4, approved by the resolution of the Cabinet of Ministers of Ukraine of 19.12.2012 No. 1201 "About approval of inventories which export and import is subject to licensing, and quotas for 2013", we report the following.
