Article 1

Bring in the Code of penal procedure of the Russian Federation (The Russian Federation Code, 2001, No. 52, Art. 4921; 2002, No. 22, Art. 2027; 2011, No. 1, Art. 45; No. 45, Art. 6324) following changes:

Part the second Article 298 to add 1) with words ", or to otherwise reveal secret of meeting of judges";

Part the fifth Article 301 to state 2) in the following edition:

"5. The judge who reserved the own opinion on the decided sentence having the right to state in writing it in the consultative room. In case of statement of the special opinion the judge has no right to specify in it data on the judgments taking place in case of discussion and adoption of the judgment of line item of the certain judges who were part of court or to otherwise reveal secret of meeting of judges.";

Article 310 to add 3) with parts five and the sixth the following content:

"5. The special opinion of the judge shall be made no later than 5 days from the date of declaration of sentence. The special opinion of the judge joins sentence and is not subject to announcement in courtroom. In case of declaration of sentence the chairman announces availability of special opinion of the judge and explains to participants of legal proceedings the right within 3 days to declare the petition for acquaintance with special opinion of the judge and term of such acquaintance.

6. The convict, justified, their defenders, legal representatives, the prosecutor, the victim, his representative and if the special opinion of the judge is connected with permission of the civil action, - the civil defendant, the civil claimant and their representatives has the right to declare the petition for acquaintance with special opinion of the judge.";
