About modification of the Presidential decree of the Republic of Belarus of April 16, 2012 No. 174
For the purpose of development of pharmaceutical industry I decide:
1. Bring in the Presidential decree of the Republic of Belarus of April 16, 2012 No. 174 "About some measures for development of pharmaceutical industry" (The national register of legal acts of the Republic of Belarus, 2012, No. 47, 1/13446) the following changes:
1.1. state item 4 in the following edition:
"4. Exempt from January 1, 2012 to December 31, 2017 from taxation by import customs duties (in case of observance of conditions of provision of the tariff privileges provided by legal acts of the Customs union within Eurasian economic community) and the value added tax the processing equipment, component parts and spare parts to it (further - goods) imported on the territory of the Republic of Belarus by the pharmaceutical organizations for exclusive use in the territory of the Republic of Belarus for the purpose of implementation of investment projects according to appendix 2.
The basis for this release is submission to customs authority (tax authority - in case of commodity importation from the territory of state members of the Customs union) the conclusions of Department of pharmaceutical industry of the Ministry of Health, confirmatory that imported goods are intended for exclusive use in the territory of the Republic of Belarus for the purpose of implementation of the investment project. Data on the name, quantity, cost of the imported goods, the pharmaceutical organizations performing their import, details of the external economic contracts, the name of the investment project, and for release from taxation by import customs duties - also confirmation about accomplishment of conditions of provision of the tariff privileges provided by legal acts of the Customs union within Eurasian economic community shall be in the specified prison.
In case of inappropriate use of the goods imported using release according to part one of this Item, import customs duties and the value added tax are paid collected) according to the legislation.
