About amnesty in connection with the tenth anniversary of adoption of the Declaration on the state sovereignty of the Republic of Kazakhstan
Due to the tenth anniversary of adoption of the Declaration on the state sovereignty of the Republic of Kazakhstan, being guided by the principles of humanity, this Law is adopted.
Article 1. Exempt from punishment of convicts for crimes of small and average weight:
1) minors, and also persons, at the time of crime execution which were minors;
2) the women having minor children or handicapped children of I and II groups which are in their dependence and also expectant mothers;
3) women is more senior than 55 years and 60 years are more senior than men;
4) participants and disabled people of the Great Patriotic War of 1941 - 1945, and also in case of flat to them persons;
5) disabled people of I and II groups.
Article 2. Exempt from punishment of persons which are not falling under operation of article 1 of this Law, for the first time convicts to imprisonment for crimes of small and average weight for a period of up to three years inclusive.
Article 3. Exempt from custodial sanction of the convicts for crimes of small and average weight who are not falling under operation of articles 1 and 2 of this Law if they served at least one third of the appointed punishment sentence.
Article 4. Exempt from custodial sanction of the persons listed in article 1 of this Law and who are not falling under operation of articles 1 - 3 presents of the Law if they served at least a half of the appointed punishment sentence.
Article 5. Exempt from punishment of persons which are not falling under operation of articles 1 - 4 presents of the Law, convicts for the first time to imprisonment for a period of up to six years inclusive if they served at least a half of the appointed punishment sentence.
Article 6. Exempt from punishment of persons condemned to the punishment measures which are not connected with imprisonment if this punishment is applied in the form of the basic.
