About amnesty in connection with the first anniversary of the new Constitution of the Republic of Kazakhstan

Due to the first anniversary of the new Constitution of the Republic of Kazakhstan, being guided by the principles of humanity, this Law is issued.

Article 1. Exempt from custodial sanction or from the punishment which is not connected with imprisonment irrespective of the appointed measure of punishment of convicts:

1) participants and disabled people of the Great Patriotic War of 1941-1945, and also persons equated to them;

2) widows of the military personnel who died in case of accomplishment of military and international duty, the women having husbands - disabled veterans and persons equated to them;

3) the women having children aged up to 16 years, handicapped children of I and II groups, and also expectant mothers;

4) men is more senior than 60 years and 55 years are more senior than women;

5) disabled people of I and II groups;

6) the minors which were earlier not containing in educational and labor colonies;

7) the military personnel condemned to the direction in disciplinary battalion.

Article 2. Exempt from custodial sanction of minors to whom operation of article 1 of this Law does not extend, condemned to imprisonment for a period of up to five years inclusive which served at least one third of sentence of punishment.

Article 3. Exempt from punishment of persons to whom operation of article 1 of this Law, for the first time convicts to imprisonment for a period of up to three years inclusive does not extend.

Article 4. Exempt from punishment of persons to whom operation of articles 1 and 3 of this Law, for the first time convicts to imprisonment for a period of up to five years inclusive which served at least one third of sentence of punishment does not extend.
