About introduction of amendments to article 4 of the Law of Ukraine "About financial services and state regulation of the markets of financial services" by types of financial services

The Verkhovna Rada of Ukraine decides:

I. Bring in article 4 of the Law of Ukraine "About financial services and state regulation of the markets of financial services" (Sheets of the Verkhovna Rada of Ukraine, 2002, No. 1, Art. 1; 2011, No. 23, Art. 160, No. 52, Art. 591; 2012, Art. No. 12-13, 82) following changes:

1) in part one:

state Item 12 in the following edition:

"12) property management for financing of construction objects and/or implementation of real estate transactions according to the Law of Ukraine "About financial and credit mechanisms and property management in case of construction of housing and real estate transactions";

add with Items 13 and 14 of the following content:

"13) transactions with mortgage assets for the purpose of issue of mortgage securities;

14) the banking and other financial services provided according to the Law of Ukraine "About banks and banking activity";

To add 2) with parts two and third the following content:

"2. Financial services which are provided by other laws are subject to inclusion in the list determined by part one of this Article. Provision of the financial services which are not included in the specified list is forbidden.

3. The bodies performing state regulation of the markets of financial services according to article 21 of this Law can make decisions within the powers:

1) about belonging of the transactions performed in the markets of financial services to certain type of the financial services determined by part one of this Article;

2) about activity definition as financial service, lack of such financial service among types of the financial services provided by the list determined by part one of this Article will also lock provisions of the specified service".

II. Final and transitional provisions

1. This Law becomes effective in three months from the date of its publication.
