About modification and amendments in the Code of civil procedure of the Kyrgyz Republic

Article 1. Bring in the Code of civil procedure of the Kyrgyz Republic (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2000, No. 3, the Art. 158) the following changes and amendments:

1. State Article 140 in the following edition:

"Article 140. Bases for providing the claim

1. According to the statement of persons participating in case, the court can take measures to providing the claim. Providing the claim is allowed in any provision of case if rejection of such measures can complicate or make impossible execution of the judgment, reference tribunal.

2. Measures for providing the claim, replacement of one type of providing the claim with another, discharge of the security of the claim and all other questions on providing the claim for the statement of the party in arbitration which is considered by permanent reference tribunal is made by the rules provided by this Chapter.".

2. Add the code with Article 141-1 of the following content:

"Article 141-1. Statement of the party of arbitration for providing the claim

1. The application of the party of arbitration for providing the claim is submitted in the location of reference tribunal or in the location or the residence of the defendant, or the location of property of the defendant.

2. Are enclosed to the application of the party of arbitration for providing the claim:

1) the copy of the action for declaration certified by permanent reference tribunal where arbitration is initiated;

2) the copy of the devolution agreement of dispute on permission reference tribunal (the arbitration agreement) certified notarially.".

3. Add Article 146 with Item 5 of the following content:
