About enhancement of judicial system of the Republic of Belarus

For the purpose of enhancement of judicial system of the Republic of Belarus, ensuring unity of court practice, improvement of quality of implementation of justice, further development of specialization of courts and judges by hearing of cases, material and staffing of courts and according to part three of article 101 of the Constitution of the Republic of Belarus I decide improvements:

1. Combine the Supreme Court and the Supreme Economic Court, having formed single supreme judicial authority on civil, criminal, administrative and economic cases - the Supreme Court heading system of courts of law of the Republic of Belarus.

Rename economic courts of areas (city of Minsk) into economic courts of areas (city of Minsk).

2. Determine that:

2.1. the system of courts of law consists from:

Supreme Court;

regional (The Minsk city) courts, economic courts of areas (city of Minsk);

district (city) courts.

In system of courts of law specialized courts can be created;

2.2. bodies of judicial community are:

congress of judges of the Republic of Belarus;

Republican judicial council;

conferences of judges regional (The Minsk city) courts and economic courts of areas (city of Minsk);

The highest qualification board of judges of the Supreme Court, qualification boards of judges regional (The Minsk city) courts and economic courts of areas (city of Minsk);

2.3. The Supreme Court is effective in structure:

Plenum of the Supreme Court;

Presidium of the Supreme Court;

judicial board on criminal cases of the Supreme Court;

judicial board on civil cases of the Supreme Court;

judicial board on economic cases of the Supreme Court;

judicial board for intellectual property of the Supreme Court.

If necessary by the President of the Republic of Belarus on representation of the Chairman of the Supreme Court in the Supreme Court other judicial boards for specialized hearing of cases can be formed;
