According to article 10 of the Law of the Republic of Belarus of January 4, 2003 "About gas supply" the Council of Ministers of the Republic of Belarus DECIDES:

1. Bring in the Instructions for use gas in life approved by the resolution of Council of Ministers of the Republic of Belarus of November 19, 2007 No. 1539 (The national register of legal acts of the Republic of Belarus, 2007, No. 288, 5/26191; 2008, No. 55, 5/27216; 2011, No. 43, 5/33641), changes and amendments, having been reworded as follows them (are applied).

2. To republican state bodies to bring the regulatory legal acts into accord with this resolution and to take other measures for its realization.

3. This resolution becomes effective in three months after its official publication.

Instructions for use gas in life

Chapter 1. General provisions

1. In these rules obligations of consumers of gas, the users of gas, the organizations performing operation of housing stock and (or) providing housing and communal services, authorized persons on management of common property (further - authorized persons), the gas supplying organizations, the service centers are determined, and also established procedure of payments for the used gas and the performed works, technical investigation of the reasons of accidents, accidents and safety requirement when using of gas in life, other questions connected with use of gas in life are regulated.

2. In these rules the following terms and their determinations are used:

emergency - the situation creating threat of life, to human health and (or) destructions of buildings, constructions, the equipment;

the internal gas pipeline - the gas pipeline placed in buildings and constructions of different function;

the gas equipment - the gas-using equipment, and also the technical devices providing accounting of consumption of gas and its safe use;

the gas-using equipment - the devices used to the personal, family, house and other needs which are not connected with implementation of business activity (cooking, water heating, heating and another);

the gas pipeline - complex of pipelines, the equipment, the devices intended for transportation of combustible gases;

gas-distribution system - the industrial complex entering gas supply system and consisting from organizationally and economically interconnected objects intended for the organization of supply with gas of consumers of gas;

the gas supplying organization - the owner of objects of gas-distribution system and (or) person authorized by him, the performing supplies with gas of consumers of gas and rendering transportation services of gas to consumers of gas;

individual balloon installation (further - IBU) - gas supply installation by the liquefied hydrocarbon gas (further - SUG) which part is no more than two 50 liter cylinders;

the individual metering device of consumption of gas - the gas consumption metering device intended for measurement of amount of consumption of the gas used for the personal, family, house and other needs which are not connected with implementation of business activity;

the user of gas - the consumer of gas and other physical person using gas only for the personal, family, house and other needs which are not connected with implementation of business activity;

the consumer of gas - the physical person acquiring gas at the gas supplying organization for the agreement for the personal, family, house and other needs which are not connected with implementation of business activity;

reservoir installation - the reservoir equipped with technical devices providing storage and giving of SUG of the set parameters;

the service center - the organization or the individual entrepreneur who signed with the gas supplying organization the agreement on work on maintenance and repair of the gas-using equipment at consumers of gas;

specialized division of the gas supplying organization - the division created for localization of incidents, accidents and liquidation of their effects on objects of gas-distribution system and gas consumption in the territory assigned to it with the round-the-clock operating mode, including days off and holidays;

repair - the repair which is carried out for providing or maintenance of the gas equipment with replacement and (or) recovery of separate parts;

maintenance - complex of transactions or transaction on maintenance of working capacity, reliability and safety of the gas equipment;

the authorized person on management of common property - the citizen or the organization appointed by local executive and administrative organ for management of common property.

3. The document granting right to use natural gas and SUG through the attached network is technical data sheet on the installed gas object constituted in form according to appendix 1, by the document granting right to use to SUG from IBU the technical data sheet on individual balloon installation constituted in form according to appendix 2 is. The specified documents are processed by the gas supplying organization after accomplishment of all installation works and passing by the consumer of gas of instructing in instructions for use gas in life and to safe use of the gas-using equipment.

4. Use of gas is performed on the basis:

contracts for gas supply, maintenance of the gas equipment and intra house gas supply systems constituted in form according to appendix 3, in case of gas supply of consumers of gas by natural gas and SUG through the attached network. In case of gas supply of the consumers of gas having gas pipelines inputs on the property right the contract for maintenance of the gas pipelines inputs belonging to consumers of gas on the property right is in addition signed;

the purchase and sale agreement SUG and the contract for maintenance of IBU and the gas-using equipment - in case of gas supply of consumers of SUG gas from IBU;

the purchase and sale agreement SUG and the contract for maintenance of reservoir installation, the gas equipment and intra house gas supply systems - in case of gas supply of the consumer of SUG gas from the reservoir installation belonging to it on the property right.

When implementing maintenance of the gas-using equipment by the service center between the service center and the consumer of gas the contract for maintenance of the gas-using equipment is signed.

The contract for gas supply, maintenance of the gas equipment and intra house gas supply systems is considered the prisoner from the moment of the first actual connection in accordance with the established procedure of the consumer of gas to the attached network.

Purchase and sale agreements SUG are signed between the gas supplying organizations or the organizations performing delivery (sale) of SUG and consumers of gas.

Agreements on maintenance of IBU and the gas-using equipment, reservoir installation, the gas equipment and intra house gas supply systems consist between the gas supplying organizations or other organizations, and also the individual entrepreneurs having special permission (license) in stipulated by the legislation case and who signed agreements with the gas supplying organizations on accomplishment of the specified works and consumers of gas.

5. Works on installation of internal gas pipelines and the gas equipment of apartment houses in case of primary gasification and capital repairs are performed by specialists of the gas supplying organizations or other organizations having the right to accomplishment of such works according to the legislation.

Shift and replacement of the gas-using equipment in use, change of intra house distributing of the gas pipeline, additional installation of the gas-using equipment which is not requiring organized withdrawal of products of combustion are performed by the gas supplying organization or other organization which signed the contract with the gas supplying organization on carrying out the specified works.

6. Works on maintenance and running repair of the gas-using equipment are performed by specialists of the gas supplying organizations or service centers.

Work types on maintenance of the gas-using equipment, frequency of their carrying out are determined in technological instructions based on technical regulatory legal acts and operation manuals on the equipment.

The service center represents annually no later than October 15 to the gas supplying organization the list of the gas-using equipment which underwent maintenance for the current year and the approved scheduled plans of maintenance the next year.

In case of not carrying out maintenance according to the approved scheduled plan the service center within five working days after month under report shall provide data to the gas supplying organization on the gas-using equipment which did not undergo maintenance.

7. In hostels in which the gas equipment is operated are appointed from among the heads and specialists who underwent in accordance with the established procedure training and examination of these rules, the faces responsible for safe operation of the gas equipment. The copy of the decision on appointment of responsible persons, and also copies of certificates of special preparation are represented to the gas supplying organization.

Persons responsible for safe operation of the gas equipment, at least once in three years undergo in the organizations of education accredited in the procedure established by the legislation on contractual basis recurring inspection of knowledge of these rules.

8. Only in the presence of emergency and (or) threat of its origin employees of the gas supplying organizations in case of presentation of the official ID by them with the photo have the right to easy access to objects of gas-distribution system irrespective of the place of their stay if other is not established by legal acts.

Access to the objects of gas-distribution system which are in premises and other legal ownerships of citizens is performed in the presence of the consumer of the gas or the other person who provided access, and in case of their absence - in the presence of representatives of the organization performing operation of housing stock and (or) providing housing and communal services or local executive and administrative organ or full age citizens with the obligatory notification of territorial authorities of internal affairs.

The harm done to property of citizens in case of penetration into premises and other legal ownerships is compensated judicially only in case of penetration without good causes. The bases are sufficient if there are no other methods of the prevention, localization, liquidation of emergency.

9. The consumer of gas living in premises has the right to refuse gas supply. At the same time other capable person having right of possession and uses of these premises has the right to the conclusion of the contract for gas supply, maintenance of the gas equipment and intra house gas supply systems.

Chapter 2. Obligations of the organizations performing operation of housing stock and (or) providing housing and communal services, authorized persons, consumers and users of gas

10. The organizations performing operation of housing stock and (or) providing housing and communal services authorized persons shall:

10.1. monitor consolidation of inputs of underground communications to cellars of buildings (except for introduction gas pipelines), to keep in working order windows and doors of auxiliary rooms;

10.2. provide if necessary to employees of the gas supplying organizations in case of presentation of the official ID by them with the photo access at any time to all auxiliary rooms for check them on gas contamination, carrying out maintenance of internal gas pipelines and the gas equipment, and also in case of emergency to render assistance in provision of access to residential and non-residential premises of the building;

10.3. provide conducting check of condition of smoke and ventilating channels by the specialized organizations according to Chapter 6 of these rules;
