About entering of amendments and changes into some presidential decrees of the Republic of Belarus

For the purpose of regulation of the address with the waste formed as a result of making with goods of transactions within customs procedures of free customs zone and free warehouse, and also improvement of the investment climate in free economic zones I decide:

1. Make additions and changes to the following presidential decrees of the Republic of Belarus:

1.1. in Item 1 of the Presidential decree of the Republic of Belarus of June 9, 2005 No. 262 "About some questions of activities of free economic zones in the territory of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2005, No. 92, 1/6516; 2006, No. 69, 1/7507; 2012, No. 26, 1/13357):

to add subitem 1.2 after words of "2010" with words "(further - the Agreement)";

in subitem 1.8-1:

state the subitem in the following edition:

"1.8-1. the waste formed as a result of making with the goods placed under customs procedure of free customs zone of the transactions established in subitems 5) and 6) * Item 1 of article 13 of the Agreement is considered for the customs purposes as processed into the condition unsuitable for their further commercial use, on condition of them:

transfers for neutralization and (or) burials to the legal entity or the individual entrepreneur (further - the organization) having special permission (license) for the activities connected with impact on the environment which constituting works and services are neutralization and (or) waste disposal (further - special permission (license);

neutralizations and (or) burials by the resident of SEZ on own subjects to neutralization and (or) waste disposal in the presence at it special permission (license);

transfers of the organization performing in accordance with the established procedure operation of object for use of waste for their further use as secondary raw materials;

uses by the resident of SEZ on the object for use of waste operated by it in accordance with the established procedure.
