About introduction of amendments to the Law of the Azerbaijan Republic "About social benefits"

In the Law of the Azerbaijan Republic "About social benefits" (Collection of the legislation of the Azerbaijan Republic, 2006, No. 2, Article 76; 2007, No. 10, Article 933; 2008, No. 6, Articles 464, 475; 2013, No. 1, Article 19, No. 6, Article 618) to make the following changes:

1. To exclude the words "and payments" from the name of Article 10.

2. Exclude Articles 10.7 and 10.8.

3. Add the Law with Article 10-1 of the following content:

"Article 10-1. Rules of allowance payment

10-1.1. Benefits, the stipulated in Article 4 presents of the Law, are paid in complete size.

10-1.2. During the period of stay of person receiving benefit on hospitalization in medical institutions, and also in leper colony the benefit is paid in complete size.

10-1.3. The allowance granted to persons living in organizations of social servicing is paid in complete size. The allowance granted to the persons who are living in organizations of social servicing, acknowledged court disabled not having opportunity independently to provide the basic vital needs, being under trying conditions, is paid to their guardians or custodians. Guardians and custodians dispose of benefit according to the Civil code of the Azerbaijan Republic.

10-1.4. In the absence of other court order, the benefit and places of detention is paid to convicts in organizations for serving sentence in complete size.

10-1.5. The amount of the benefit which is not received for last period is paid irrespective of its term.

10-1.6. The benefit for burial in connection with death of person receiving benefit is paid to persons who incurred expenses in connection with his burial.

10-1.7. The amount of the benefit which is subject to payment to person receiving benefit, but this face which is not paid in connection with death, is paid according to the Civil code of the Azerbaijan Republic.".
