For the purpose of realization of provisions of the Law of the Republic of Kazakhstan "About road transport" and determinations of single requirements to transportations of passengers and baggage by road transport of the Republic of Kazakhstan, I ORDER:
1. Approve the enclosed Rules of transportations of passengers and baggage by road transport.
2. To management of road transport (Makhanov Sh. K.) provide submission of this order for state registration in the Ministry of Justice of the Republic of Kazakhstan.
3. To impose control of execution of this order on the Vice-Minister of Transport and Communications of the Republic of Kazakhstan Koshanov E. Zh.
4. This order becomes effective from the date of official publication, except for forms of travel documents (tickets) and luggage receipts specified in appendix 1 to Rules of transportation of passengers and baggage by road transport which become effective since January 1, 2005.

1. These rules of transportations of passengers and baggage by road transport (further - Rules) establish procedure for the organization and implementation of motor transportations of passengers and baggage.
2. Rules act on all territory of the Republic of Kazakhstan and are obligatory for all physical persons and legal entities irrespective of patterns of ownership.
3. The luggage receipt - the document confirming the conclusion of the agreement of motor transportation of baggage, and also acceptance of baggage by carrier on storage or for transportation (Appendix 1).

5. The ticket - the document certifying the right of the passenger to perform trip and confirming the conclusion of the agreement of motor transportation of the passenger (Appendix 1).
6. The logbook - the numbered and strung together magazine which is on the vehicle in which marks about passing of pretrip technical inspection of the vehicle and pretrip (prereplaceable) medical examination of the driver (Appendix 2) are put down.
7. Route - the established bus transit between certain starting, intermediate and terminal stopping points.

9. Dangerous sites - sections of highways, driving through which is integrated to the increased risk of involvement in the road accident or is connected with essential changes of the mode of movement.
10. Item of landing and disembarkation of passengers (stopping point) the site of roadside strip equipped according to requirements of these rules intended for stop of vehicles for the purpose of landing and disembarkation of passengers.
11. The schedule of movement - the document (table) containing data on the place and time of movement of buses, minibuses on each stopping point of route of regular motor transportations of passengers and baggage.
12. Flight - way of the bus, the minibus from route, initial to terminal point.
13. The scheme of route - the graphical conditional representation of route with indication of stopping points, distances between them, and also characteristic reference points (road forks, intersections, railway crossings, bridges, tunnels and so on).
14. On nature of the organization motor transportations of passengers and baggage are subdivided on regular and irregular.
15. Regular motor transportations of passengers and baggage are performed by buses and minibuses along the established routes according to the schedule of movement.
Under the organization of regular motor transportations of passengers and baggage on city routes vehicles (buses or minibuses) which will be used for implementation of transportations are determined in advance.
16. When implementing regular motor transportations of passengers and baggage the carrier provides availability on the vehicle of the route sheet (Appendix 3) with marks about passing of pretrip (prereplaceable) medical examination of the driver and technical inspection of the vehicle.
17. Irregular motor transportations of passengers and baggage will be organized by carriers and performed with use of the buses, minibuses and cars conforming to requirements of these rules.
18. Irregular transportations are subdivided on:
1) transportations by non-repeat orders (requests) of legal entities and physical persons. Treat such transportations: tourist, excursion, on servicing of activities.
The specified one-time transportations can be performed on contractual basis during the certain period.
2) transportations by cars, taxi.
19. The vehicles which had technical inspection according to the legislation of the Republic of Kazakhstan are allowed to motor transportations of passengers and baggage.
At the same time the design and technical condition of the buses used in case of motor transportations of passengers and baggage shall conform to requirements of the corresponding standards.
20. The buses and minibuses used in case of motor transportations of passengers and baggage shall conform to requirements of ST of RK 1040-2001 "Services motor transportation on passenger traffic. General specifications", the approved order of Committee on standardization, metrology and certification of the Ministry of Economy and Trade of October 22, 2001 N 378, at the same time:
1) on routes of regular city and suburban motor transportations use of the city buses (class I) having at least two passenger doors, minibuses, and also intercity buses (class II) on routes of regular suburban motor transportations is allowed;
2) on routes of regular long-distance and international motor transportations intercity buses (class II) or buses of distant following shall be used (class III). At the extent of these routes to 150 kilometers (further - the km) is allowed to use minibuses.
21. The buses used on routes of regular long-distance and international motor transportations of passengers and baggage more than 150 km long shall have soft sitting with folding backs. If the extent of route constitutes more than 500 km, then in inside of the bus the place for the driver relief shall be provided.
22. On mountain routes buses with run more than 500 thousand kilometers or being exposed to capital repairs are not used.
The buses used on mountain routes shall be equipped with front fog lights and auxiliary headlights of backing, and height of the drawing of protector of tires shall be at least 3,0 of millimeters (further - mm).
23. Buses, minibuses shall be completed:
1) the medical first-aid kit (motor transportation) with necessary set of drugs and medical means;
2) it is excluded
3) sign of emergency stop;
4) operational fire extinguishing means;
5) the corresponding devices of the emergency opening of emergency hatches and information plates to them, doors, windows and removal of glasses in case of the road accident;
6) it is excluded
24. The buses, minibuses used in case of motor transportations of passengers and baggage shall have:
1) doors of passenger salon and emergency hatches which are opening and closed without any hindrances. Doors shall not have ledges, sharp or far remote from their surface;
2) roof, emergency hatches and windows which in the closed condition completely prevent hit of atmospheric precipitation in cabin of the driver and passenger salon;
3) firmly the fixed hand-rail and sitting;
4) net and without rushes of covering of seats and backs of chairs for passengers;
5) equal, without speakers or loose details, footboards and floor of salon.
Floor covering of salon shall be made of continuous material without rushes;
6) the transparent glasses of windows purified of dust, dirt, paint and other objects reducing visibility through them. Each window opening shall not be closed by information or promotional materials more than for 30%;
7) the passenger salon heated in cold and ventilated in hot season, which is not encumbered with the tool and spare parts.
25. Wet cleaning of insides of the buses and minibuses used in case of regular motor transportations of passengers and baggage is carried out at least once to change and in process of pollution.
The outside sink of body is carried out after the end of change.
26. The buses and minibuses used on routes of long-distance and international motor transportations of passengers and baggage shall have luggage compartments, and also are completed with reserve wheel and jack.
27. Control devices of registration of work-rest schedule of drivers (tachographs) the buses used when implementing are subject to the equipment:
1) international motor transportations of passengers and baggage;
2) long-distance interregional regular and irregular motor transportations of passengers and baggage.
28. In inside of buses near cabin (place) of the driver information containing shall be had:
1) full name of carrier;
2) numbers of contact telephone numbers of carrier, organizer of transportations;
3) phone numbers of territorial authorities of road traffic police and transport control;
4) copy of the scheme of route;
5) data on fare.
For regular routes (except for city routes) the table of fare and conveyance depending on trip distance shall be provided;
6) size of penalty for unpaid journey and/or conveyance;
7) rights and obligations of passengers.
The buses and minibuses used in case of regular city motor transportations of passengers and baggage shall be equipped with loud-speaking installation, in case of functioning of automated control system (further - ACS) the control unit behind work on the line.
For irregular motor transportations of passengers and baggage action of subitems 4), 5) and 6) of this Item do not extend.
29. In the front and back parties of buses (minibuses) used in case of regular city and suburban motor transportations of passengers and baggage cliches with indication of number of route are established.
Number of route shall be written in black color (font height at least 120 mm) on light yellow background. In case of implementation of express transportations on cliche at number of route there shall be text "Express" of red color (font height at least 60 mm).
30. On the right side of the buses used on city routes regular motor transportations of passengers and baggage near one of passenger doors of salon the cliche with number and the short description of route (the name of intermediate and final stops, the main streets on which there passes the route, socially significant places) shall be located on the state and Russian languages.
31. Buses of long-distance and international routes shall have front and side (on the right side) cliches with indication of initial, final and large intermediate points of following on state and Russian, and if necessary, and in other languages.
32. Front and back cliches shall have illumination in night-time.
33. The buses intended for motor transportation of organized groups of children shall have at least two doors. Besides, by these buses identification marks "Transportation of children" and the flashing indicator of yellow color are in front and behind established.
34. On the front and back parties of the vehicles used when transporting passengers and baggage by custom buses, minibuses and cars cliches with text "Custom" are established.
The text shall be made in black color (font height at least 120 mm) and is placed in rectangular frame.
35. Places for disabled people, pensioners, expectant mothers and passengers with children of preschool age are provided in front part of inside of the buses used in case of regular motor transportations of passengers and baggage. Near these places the information display specifying their purpose shall be located.
36. The taxi is equipped with the identification mark located on roof and well distinguishable from distance to 500 meters (further - m). The identification mark shall have text of "T" (taxi) and/or characteristic checkerboard belt and be highlighted in night-time.
36-1. The taxi external on lateral faces is drawn up by the belt consisting of the black and yellow squares located in chessboard order, the size:
height - 30 centimeters;
length - at least 100 centimeters.
37. The taxi shall be equipped with the operational, confided authorized body on standardization and the sealed-up taximeter.
38. In salon of taxi in sight of passengers there shall be business card of the driver with the photo, specifying of surname, name, middle name, and also information display with indication of the official name of carrier, its address and phone number.
39. The Ministry of Transport and Communications of the Republic of Kazakhstan, local executive bodies, physical persons and legal entities can act as initiators of opening of routes of regular motor transportations of passengers and baggage.
40. On opening of routes of regular motor transportations of passengers and baggage the initiator develops the scheme of route and the schedule of movement for the solution of questions on it and sends them to organizers of transportations:
along routes regular international, long-distance interregional and connecting settlements: settlements, auls (villages) among themselves and the district centers out of one area - motor transportations of passengers and baggage - in the Ministry of Transport and Communications of the Republic of Kazakhstan;
along routes regular suburban, long-distance intraregional and connecting settlements: settlements, auls (villages) among themselves and the district centers out of one district of the area, and also with the regional centers, with the cities of republican value (capital) of motor transportations of passengers and baggage - in local executive bodies of area;
along routes of regular city motor transportations of passengers and baggage - in local executive bodies of the city;
along routes regular connecting settlements: settlements, auls (villages) among themselves and the district centers of one region of the area - in local executive bodies of the area.
41. New routes of regular transportations of passengers and baggage can be organized if:
1) highway capability allows to perform regular movement of buses, along certain routes;
2) the condition of highways and their arrangement conform to safety requirements of traffic;
3) the conditions specified in Item 45 of these rules are satisfied.
42. When forming route network of regular transportations of passengers and baggage by road transport local executive bodies are guided by communication priority between settlements, auls (villages) with the district centers, and between the district centers with the regional center and other nearby cities of regional value.
43. When forming route network of regular transportations of passengers and baggage by road transport execution of the following principles is provided:
satisfaction of need of the population for transportations along each route;
rational use of capacity of buses on the established regulations;
creation of accommodation requirements to passengers along the line;
accounting of handling capacity of roads, stopping points and other infrastructure facilities;
observance of standard rates and service regulations of buses, safety requirements of traffic;
minimization of costs of time of passengers for trips;
frequency of movement of buses along all integrated routes;
observance of the mode and working conditions of drivers according to the order of the deputy. 45. The created route network (except city routes) shall correspond to the following conditions:
The difference according to the schedule of movement in case of duplication by the offered routes of the operating routes shall constitute 1) on time:
more than 1 hour on duplication extent to 150 km;
more than 2 hours on duplication extent to 350 km;
more than 3 hours on duplication extent to 500 km;
more than 4 hours on duplication extent over 500 km;
2) in case of average fillability of buses (separately on summer and winter season) on sites of duplication more than seventy five percent the difference on time is reduced:
up to 15 minutes on duplication extent to 150 km;
up to 30 minutes on duplication extent to 350 km;
till 1 o'clock on duplication extent over 350 km.
