About introduction of amendments to the Federal law "About Lotteries" and separate legal acts of the Russian Federation

Article 1

Bring in the Federal Law of November 11, 2003 No. 138-FZ "About lotteries" (The Russian Federation Code, 2003, No. 46, Art. 4434; 2005, No. 30, Art. 3104; 2006, No. 6, Art. 636; 2008, No. 30, Art. 3616; 2010, No. 27, Art. 3414; No. 31, Art. 4183; 2011, No. 27, Art. 3880; No. 30, Art. 4590; 2013, No. 19, Art. 2326) following changes:

1) in Article 2:

a) in Item 1 of the word" (the organizer of lottery)" shall be replaced with words "(the operator of lottery)", words "lotteries. The contract between the organizer of lottery and the participant of lottery consists on voluntary basis and is drawn up by issue of the lottery ticket, receipt, other document or other method provided by lottery conditions" shall be replaced with words "lotteries. "5) the lottery ticket - the document certifying the participation right in lottery and confirming the conclusion of the contract between the operator of lottery and the participant of lottery;";

d) add with Items 5.1 and 5.2 of the following content:

"5. 1) the lottery receipt - the fiscal document issued by the lottery terminal, certifying the participation right in lottery and confirming the conclusion of the contract between the operator of lottery and the participant of lottery;

5. 2) the electronic lottery ticket - the electronic document certifying the participation right in lottery, confirming the conclusion of the contract between the operator of lottery and the participant of lottery, containing the protected information on the registered lottery rate (lottery rates) placed in the center of processing of lottery information and allowing to identify the participant of lottery who paid lottery rate (lottery rates) according to the procedure established by lottery conditions taking into account requirements of the Federal Law of July 27, 2006 No. 149-FZ "About information, information technologies and on information security";";

e) Items 6 - 16 to state in the following edition:

"6) the organizer of lottery - the federal executive body authorized by the Government of the Russian Federation in accordance with the established procedure on carrying out lottery. The organizer of lottery carries out lottery through the operator of lottery by means of the conclusion of the contract with it;

7) the organization of lottery - implementation of the actions including carrying out tender at the choice of the operator of lottery, the conclusion of the contract with the operator of lottery, approval of conditions of lottery;

8) carrying out lottery - rendering services in implementation of the actions including distribution (realization, accounting) of lottery tickets, electronic lottery tickets, accounting of lottery receipts, the conclusion of contracts with the manufacturer of lottery tickets, the manufacturer of the lottery equipment, lottery terminals, distributors and (or) others agreements, necessary for carrying out lottery, the conclusion of contracts with participants of lottery, including acceptance and accounting of lottery rates, draw of prize fund of lottery, examination of advantageous lottery tickets, lottery receipts, electronic lottery tickets, payment, transfer or provision of prizes to participants of lottery;

9) the operator of lottery - the legal entity registered in accordance with the legislation of the Russian Federation and who signed the contract with the organizer of lottery for carrying out lottery according to this Federal Law;

10) the distributor - person who signed the contract for distribution (realization, issue) of lottery tickets, lottery receipts, electronic lottery tickets, acceptance of lottery rates among participants of lottery, payment, transfer or provision of prizes to participants of lottery;

11) the participant of lottery - the person which reached age of eighteen years, having the participation right in draw of prize fund of lottery based on the agreement signed with the operator of lottery;

12) revenue from carrying out lottery - the money received from implementation of lottery tickets, acceptance of lottery rates of specific lottery;

13) target assignments from lottery - the part of revenue from carrying out lottery directed to the purposes determined by article 11 of this Federal Law;

14) the lottery equipment - the device (random number generator, the mechanical, electric, electronic or other technical device) used for determination of the won lottery combination (the won lottery combinations) of drawing lottery;

15) lottery rate - the price of one paid lottery combination. Acceptance of lottery rate (lottery rates) is confirmed by issue to the participant of lottery of the lottery ticket, lottery receipt, the direction to the participant of lottery of the information message about acceptance of lottery rate (lottery rates) and registration of the electronic lottery ticket;

16) the annual statement about carrying out lottery - data which the operator of lottery annually shall publish in mass media and (or) post online "Internet". The scope of information, included in the annual statement about carrying out lottery, and procedure for its publication are determined by the federal executive body authorized by the Government of the Russian Federation;";

e) add with Items 17 - 21 following content:

"17) lottery combination - the set of the texts, drawings, symbols or numbers applied (brought) on the lottery ticket, the lottery receipt and the electronic lottery ticket provided by lottery conditions;

18) the lottery terminal - the technical device intended for acceptance of lottery rates (input or the choice of lottery combination or lottery combinations) both issues of lottery receipts and used when carrying out drawing lotteries;

19) the lottery program - the program for electronic computers developed and used for data collection about widespread lottery tickets and the accepted lottery rates, their accounting and registration or control of the lottery equipment when holding draw of prize fund of drawing lottery. The lottery programs used when carrying out lottery shall not contain the hidden opportunities which are not described or do not correspond to the opportunities described in technical documentation of the software and when which using violation of confidentiality, availability or integrity of the processed information is possible;

20) the center of processing of lottery information - the complex of software and hardware connected to Internet network and other communication networks for obtaining and information transfer from lottery terminals (to lottery terminals) and allowing to register lottery rates, electronic lottery tickets, and also to keep and process information on them. The center of processing of lottery information shall provide information security from loss, plunders, misstatements, counterfeits, unauthorized actions for its destruction, modification, copying and similar actions, and also from unauthorized access on Internet network;

21) circulation - the number of the realized lottery tickets, lottery receipts, electronic lottery tickets participating in draw of prize fund (part of prize fund) of lottery in accordance with the terms of lottery.";

2) in Article 3:

a) state parts 1 and 2 in the following edition:

"1. Types of the lottery which is carried out in the territory of the Russian Federation are determined depending on method of its carrying out and the territory of its carrying out.

2. The lottery depending on method of its carrying out is subdivided on drawing and no-draw.
