About introduction of amendments to the Law on regime of foreigners in the Republic of Moldova No. 200 of July 16, 2010

This law provides partial transposition of Articles 12, 34 and 35 Regulations of the European Parliament and Council 810/2009/EU of the July 13, 2009 establishing the Code of the Community about visas (The visa code) published in the Official magazine of the European Union by L 243 of September 15, 2009.

The Parliament adopts this organic law.

Art. I. - In the Law on regime of foreigners in the Republic of Moldova No. 200 of July 16, 2010 (Official monitor of the Republic of Moldova, 2010, Art. No. 179-181, 610), with subsequent changes, to make the following changes:

1. Part (Article 16 to state 2) in the following edition:

"(2) the Transit airport visa is obligatory for natives of the states which citizens shall have the visa in case of entrance, departure and transit on the territory of the Republic of Moldova according to the national legal system. The same mode is applied also to foreigners who have the documents on the right of crossing of frontier issued by bodies of the states which citizens shall have the visa, but who are not citizens of the relevant states".

2. State Articles 21 and 22 in the following edition:

"Article 21. Issue of visas in exceptional cases

(1) In exceptional cases the visa is issued at check points through frontier under the following circumstances:

a) in the urgent situations caused by catastrophic crashes, natural disasters or accidents;

b) in case of death or serious illness of the relatives who are in the territory of the Republic of Moldova supported by the documents issued by competent authorities;

c) in case of emergency situations in which appeared water or the aircrafts of foreign states forced to moor or make landing owing to defects, bad weather, threat of act of terrorism - to members of crews and passengers.

(2) In exceptional cases the visa is issued at check points through frontier in case of observance of the following conditions:

a) the applicant corresponds to the conditions of entry into the Republic of Moldova provided by Items and), c) d), e) and f) parts (1) Article 6;
