About introduction of amendments to Criminal and Criminal procedure codes of Ukraine concerning implementation in the national legal system of provisions of article 19 of the Convention of the UN against corruption

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Criminal code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2001, Art. No. 25-26, 131):

1) in Article 364:

in paragraph one of part one of the word "from mercenary motives or in other private interests or for the benefit of the third parties" shall be replaced with words "for the purpose of receipt of any illegal benefit to itself or other physical person or legal entity";

third to exclude part;

in paragraphs one and the second Item 1 of the note to Article of figure "365" to exclude;

in Item 3 of the note to Article of figure "365 - 1" exclude;

2) in the note to Article of 364-1 figure "364-1" replace with figures" 364, 364-1";

Article 365 to state 3) in the following edition:

"Article 365. Excess of the power or office powers by the employee of law enforcement agency

1. Exceeding of the power or office powers, that is intentional making by the employee of law enforcement agency of the actions which are obviously going beyond the rights or powers granted to it if they did essential harm to the rights protected by the law, to interests of certain citizens, the state or public concerns, interests of legal entities, -

it is punished by restriction of freedom for a period of up to five years or imprisonment for a period of two up to five years with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of up to three years.

2. The actions provided by part one of this Article if they were followed by violence or threat of use of violence, use of weapons or special means or the painful and offending personal advantage of the victim actions, in the absence of signs of tortures, -
