About modification and amendments in some legal acts

The Parliament adopts this organic law.

Art. I. - In the Law on the status of the judge No. 544-XIII of July 20, 1995 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 15-17, 63), with subsequent changes to make the following changes and additions:

1. Part (Article 6 to add 1) with Item g) the following content:

"g) last testing using the detector of simulation (polygraph).".

2. Add Article 8 with part (3-1) following of content:

"(3-1) communication of the judge with participants of process or with other persons, including persons who are taking up responsible state positions is not allowed if such communication is connected with the case which is in production of the judge and occurs other, than it is provided by rules of practice, image. Communication is forbidden from the moment of registration of case in degree of jurisdiction and before pronouncement not of the decision which is subject to appeal on case. Any communication out of judicial sessions is performed in writing with obligatory familiarizing of the corresponding materials for case.".

3. Part (Article 9 to state 7) in the following edition:

"(7) at the time of giving of document package the applicant is informed on initiation of check according to the Law on check of persons holding the state positions, and candidates for the state positions No. 271-XVI of December 18, 2008 and about obligation of passing of testing on polygraph according to the Law on application of testing on the detector of simulation (polygraph) No. 269-XVI of December 12, 2008. The applicant shall sign the declaration on check and provide the written consent to passing of testing on polygraph.".

4. In Article 15:

part (to add 1) with the Item f-1) of the following content:

"declare f-1) acts of corruption and acts, the facts of corruption behavior, adjacent to it, which became known to it on duty;";
