About modification and amendments in some legal acts

The Parliament adopts this organic law.

Art. I. - Article 12 of the Law on domestic trade No. 231 of September 23, 2010 (2010, 681), with subsequent changes, to state the official monitor of the Republic of Moldova to Art. No. 206-209, in the following edition:

"Article 12. The organization of trade in the markets

(1) the Market is specially equipped zone in which are implemented mainly agricultural products, food and nonfoods, and also services through the trade items placed here.

(2) Depending on specifics of implementable goods the markets can be the following types: the food agricultural markets, the nonfood markets, car markets, the flower markets, commodity markets of second hand, the mixed markets, etc.

(3) the Markets function based on the permission to placement and implementation of activities issued by body of local public authority according to the current legislation.

(4) the Markets are controlled the administrator of the market which the body of local public authority or business entity, according to the current legislation can be direct.

(5) Trade places in the food agricultural markets and in the mixed markets in first-priority procedure are provided to domestic agricultural manufacturers based on the manufacturer's certificate of origin issued primary the settlement. The quota of trade places for domestic agricultural manufacturers is established by the administrator of the market depending on market type, but cannot constitute less than 50 percent of the floor space of the food agricultural market and 30 percent of the floor space of the mixed market.

(6) Rates for services of the market are established by the administrator of the market on the basis of the principles of transparency, nondiscrimination and economic justice and within 30 calendar days will be approved with body of local public authority. The size of rates is determined taking into account expenses on market provision of services. Establishment of payment for the admission on the market is forbidden.
