For the purpose of rational use of mineral raw material resources, enhancement of the mechanism of stimulation of the companies of the extracting industries in the conditions of favorable environment of the world prices for highly liquid products, optimum distribution of the received excess profit, and also replenishment of the income of the government budget Cabinet of Ministers decides:
1. Enter since June 1, 2004 for the separate companies of the extracting industries the excess profit tax.
Determine that the list of the specific companies paying the excess profit tax, and also the sizes of rates of tax are established by the Cabinet of Ministers based on the offers made by the Ministry of Finance together with the Ministry of Economics of the Republic of Uzbekistan.
2. Determine that:
JSC Almalyk Mining and Smelting Plant since June 1, 2004 is taxpayer on excess profit, levied depending on the level of the world price for copper, at the rates approved by the Cabinet of Ministers of the Republic of Uzbekistan;
means, being at the command plant after the tax discharge on excess profit, accumulate on the special account of JSC Almalyk Mining and Smelting Plant in authorized bank for subsequent target use on implementation of the investment projects approved with the Ministry of Economics of the Republic of Uzbekistan;
in case of not transfer to the special account or inappropriate use of the means accumulated on the special account, these means in full are collected in the government budget using the penalties provided by the current legislation.
3. To the Ministry of Finance, the State Tax Committee of the Republic of Uzbekistan in week time to develop and approve procedure for calculation and collection of the excess profit tax of JSC Almalyk Ore Mining and Smelting Plant.
