About modification and amendments in the orders of the Government of the Republic of Kazakhstan of January 31, 2001 No. 168 "About approval of some instructions" and of December 10, 2002 No. 1300 "About Regulations of the Government of the Republic of Kazakhstan"
The government of the Republic of Kazakhstan DECIDES:
1. Bring the following changes and amendments in some decisions of the Government of the Republic of Kazakhstan:
1) in the order of the Government of the Republic of Kazakhstan of January 31, 2001 No. 168 "About approval of some instructions":
in the Instruction on clerical work in Prime minister's department of the Republic of Kazakhstan approved by the specified resolution:
state Items 3 and 4 in the following edition:
"3. This Instruction determines rules of preparation, registration, passing of the documents of unclassified nature containing office information of limited distribution marked "For office use" including internal documents if other is not established by this Instruction.
Preparation, acquaintance and passing of the documents containing office information and/or office information marked "For office use" limited distribution are carried out according to the Rules works of state bodies with office information approved by the order of the Government of the Republic of Kazakhstan of January 23, 2008 No. 51 chipboard, and requirements for protection of the information resources used in Office.
Provisions of this Instruction extend to the organization of work with official documents and internal documents, irrespective of carrier type, including the electronic documents certified by the digital signature with use of the closed (confidential) key of the digital signature (further - the EDS), and means of the EDS (the means of cryptographic information security which are realizing the processes of forming and verification of the EDS) and having confirmation about determination in accordance with the established procedure of positive result of verification of the EDS (confirmation (establishment) of authenticity of the EDS) after calculation and verification of the EDS of the electronic document with use of open key of the EDS.
4. This Instruction does not regulate procedure:
1) works with appeals of physical persons and legal entities, and also reception of citizens in Office which is established by the Instruction about procedure for consideration of appeals of physical persons and legal entities and control of their execution;
2) the organizations of control of execution of documents which is established by the Instruction on the organization of control of execution of documents in Office, the central and local executive bodies;
3) maintaining confidential clerical work and confidential correspondence with use of the encoded document connection which is established by separate special instructions.";

"6. The inspection department and documentary providing (further - OKDO) informs the new staff of Office of this Instruction and other documents regulating activities of Office.";

Correspondence arriving in Office is accepted by OKDO under list with indication of date, time, surname and initials of person who received documents, and electronic documents certified by the EDS, - after holding procedure of check of authenticity of the EDS with use of open key of the EDS and means of cryptographic information security which are realizing processes of forming and verification of the EDS (means of the EDS), and also undergone the procedure of confirmation of conformity according to the procedure, established by the legislation of the Republic of Kazakhstan in the field of technical regulation.";
"Documents from storage durations to 10 years (except documents with storage durations of 75 years, constantly, with mark "Expert survey board" (further - EPK) are accepted and go only electronically the electronic documents certified by the EDS.";

"11. The employee of OKDO before opening of envelopes checks correctness of their addressing and registration, integrity of packaging (in the presence of seals). Envelopes from the arriving correspondence join correspondence only in that case when only on envelope it is possible to establish surname, name, middle name and the sender's address, time and date of sending and receipt of documents.
All envelopes, except for envelopes with the mark "Personally" are subject to opening in OKDO.
The accepted documents and packets with the mark "Personally" (except appeals of physical persons and legal entities) are considered in registers and transferred without opening directly to the addressee.
12. The first copies of documents which shall be drawn up on the form of the established sample, signed by the first head (in its absence - person fulfilling its duties, in the presence of the order), the responsible secretary on the questions carried to its competence, the official of the ministry or agency, certain President of the Republic of Kazakhstan and performing powers of the responsible secretary, and created with use of the template of the electronic document corresponding to it with the filled details (the electronic documents certified by the EDS, having confirmation about determination in accordance with the established procedure of positive result of verification of the EDS) are subject to acceptance in Office.
To letters of the state bodies responsible for execution of orders of the Management of the Government, the copies of letters of the state bodies collaborators certified by stamp are without fail put. On the document shall be put down: date, reference number, short heading of the document, in case of reply to the request or the report (information) on execution of orders - the reference to registration number of Office. At the same time the Office accepts only those documents which date matches with date of their delivery in Office (except correspondence from another town which arrived by mail).
The surname, initials, phone number, the e-mail address of the contractor, identification number ESEDO of Office, and also number of copies of the document are without fail put down in the bottom left corner after the signature or on the back of the first document sheet (for example: Asanov S.A., ph. 742469, Asanov.S@ukimet.kz (identification number ESEDO of Office). Appendices to the document shall be initialed by the person which signed or preparing the document (the contractor of the document).
Drafts of answers to the President of the Republic of Kazakhstan, in Presidential Administration, to deputies of Parliament, the Prosecutor General's Office and to Calculating committee on control of execution of the republican budget are initialed by the first head of the state body which developed this draft of the answer or person fulfilling its duties.
Correspondence of state bodies (including the electronic documents certified by the EDS) addressed to management of the Government and the Head of Office shall be drawn up on the stamp form in state language (the signed option in Russian without form is in case of need put).
In case of acceptance of the electronic documents certified by the EDS, number of copies is not considered.
The documents arriving in the form of the electronic documents certified by the EDS (only electronically) Office are accepted from 9:00 till 17:00 o'clock. The documents which arrived after the specified term can be accepted only on specifying of the Head of Office or his deputies.
13. Are not subject to acceptance in Office:
1) the documents and appendices to them which are drawn up with violation of the established requirements of this Instruction;
2) the documents containing the facsimile, blots and other pollution having any damages including punctured with puncher, performed on draft copies and copies of forms of state bodies;
3) incorrectly addressed (the wrong writing of the name of Office, position, surname, name, middle name of the Management of the Government and Office) letters;
4) the letters of state bodies which are not containing the copy of letters of the state bodies collaborators;
5) documents, including in the form of electronic documents, not corresponding to the original on paper (negative result of verification of the EDS, content, the number of sheets, lack of obligatory details and/or the wrong arrangement of the details provided by form form and also the text);
6) the documents arriving only in the form of electronic documents of the Rules of electronic document management which are not conforming to requirements approved by the order of the Government of the Republic of Kazakhstan of April 17, 2004 No. 430.";

"13-3. Correspondence (documents) accepted by the staff of Office owing to office need passing OKDO, it shall be transferred without delay to registration to the sector of clerical work and OKDO archive.";

The letters of foreign correspondents which arrived in Office in foreign languages after preliminary consideration of OKDO go on accessory to reception managements of the Government, Office and structural divisions.";

"14. Documents after preliminary consideration by the manager of OKDO and registration are transferred on competence to reception managements of the Government, Office and structural divisions under list with fulfillment of requirements of Items 20 and 21 of this Instruction. The source documents which arrived only in electronic form are printed out on paper with assurance in accordance with the established procedure for the subsequent report to management.

3) the appeals of state bodies, akims of areas and cities of Astana and Almaty or separate legal entities requiring decision making of the Government or the Prime Minister, including about assignment from the republican budget and reserve of the Government, but not worked in the central executive bodies which competence the questions which are brought up in addresses enter;
4) information which submission is not provided by the established reporting;
5) information on execution of the orders which are not on control of the Government, and on which specific instructions about, need were not given to inform the Government and/or Office;

7) the documents prepared with violation of requirements of Regulations of the Government of the Republic of Kazakhstan and this Instruction.
15. Confidential correspondence is processed only in the sector of confidential clerical work and information security of OKDO (further - the sector of confidential clerical work and information security).
16. When there is ambiguity in further movement of documents, they are reported on the manager of OKDO, and if necessary - to the Head of Office or his deputies";

"17. According to Regulations of the Government and Regulations on Office of the appeal of legal entities and physical persons which do not require consideration by the Government and can be solved by the central and local executive, other state bodies, go the manager of OKDO (to its absence - the assistant manager) to the relevant ministries, the agencies, akims and other state bodies";

6) letters and resolutions of Calculating committee on control of execution of the republican budget;

8) the addresses connected with the exit visa in business trip of heads of the ministries, agencies, akims of areas and cities of Astana and Almaty, chairmen of boards of joint-stock companies "National welfare fund "Samruk-Kazyna" (further - "NWF of Samruk-Kazyna), "National managing holding "Kazagro" (further - "NUH "Kazagro"), "National managing holding "Bayterek" (further - "NUH "Bayterek"), in 3 (three) days prior to departure;
to deputy prime ministers it is submitted: correspondence (documents), it is direct addressed to them, and also on the questions supervised by them according to distribution of obligations between the Prime Minister, his deputies and the Head of Office;
To the head of Office go:
1) materials concerning control of timely and high-quality execution of acts and orders of the President of the Republic of Kazakhstan, the Government and the Prime Minister, his deputies according to Regulations of the Government, Regulations on Office and distribution of obligations between the Prime Minister, his deputies and the Head of Office;
2) deputy requests to the Government and Prime Minister;
3) the documents connected with holding meetings of the Government, meetings, other actions of republican level;
4) documents according to Regulations of the Government, Regulations on Office and distribution of obligations between the Prime Minister, his deputies and the Head of Office;
to the deputy manager of Office (supervising legal issues) go:
1) on preliminary consideration all correspondence (documents) addressed in Legal department;
2) copies of materials on the questions submitted for meeting of the Board of Directors of joint-stock companies "by NWF of Samruk-Kazyna and "NUH "Bayterek";
state Item 26 in the following edition:
"26. The summary of incoming documents and the resolutions of the Prime Minister adopted according to them is entered in the database of registration and control card (further - RKK).";
to state part one of Item 27 in the following edition:
"27. The documents addressed to deputy prime ministers, the Head of Office are transferred according to assistants (advisers) to deputy prime ministers and the Head of Office or to employees of receptions which undersign for receipt of documents for OKDO in RKK, the register with indication of date and time of obtaining.";
state Item 29 in the following edition:
"29. The staff of departments prepares draft resolutions of the Head of Office on requests of deputies of Parliament in coordination with other relevant structural divisions of Office.
Draft resolutions of the Prime Minister under acts of public prosecutor's supervision, addresses and resolutions of Calculating committee on control of execution of the republican budget and the Constitutional Council of the Republic of Kazakhstan are approved with the Deputy prime minister supervising question, and also the Legal department and the deputy manager of Office (supervising legal issues).
