About modification and amendments in the Code about elections No. 1381-XIII of November 21, 1997

The Parliament adopts this organic law.

In the Code about elections No. 1381-XIII of November 21, 1997 (Official monitor of the Republic of Moldova, 1997, No. 81, of the Art. 667), with subsequent changes, to make the following changes and addition:

1. In Article 177:

part (to state 1) in the following edition:

"(1) the questions which are essential for the respective settlement and relating only to the established law to powers of bodies of local public authority can be submitted For local referendum.";

add Article with part (1-1) following contents:

"(1-1) Text of the question submitted for local referendum shall it is constituted neutrally, without ambiguity or the hint of the answer. Mutually exclusive questions are not allowed.".

2. State Article 178 in the following edition:

"Article 178. Questions which cannot be submitted for local referendum

Questions cannot be submitted for local referendum:

a) national value which according to the powers determined by the Constitution and the legislation are within the competence of Parliament, Government or other central bodies of the public power;

b) the states relating to domestic and foreign policy;

c) the Constitutions contradicting provisions and legislations of the Republic of Moldova;

d) about taxes and the budget;

e) about emergency or urgent measures on ensuring public order, health and safety of the population;

f) about election and position assignment, release and response about the positions of persons which are within the competence of Parliament, the President of the Republic of Moldova and the Government;

g) about withdrawal of the primar relieved of the post based on the decision of degree of jurisdiction which took legal effect;

h) being within the competence of degrees of jurisdiction or prosecutor's offices;

i) about change of administrative-territorial subordination of the settlements, except as specified, provided by the Law on special legal status of Gagauzia (Gagauz Erie).".
