Article 1. This Provision regulates activities of the Highest qualification board of judges of courts of law (further - the Highest qualification board of judges), Qualification board of judges of economic courts, and also qualification boards of judges of courts on civil and criminal cases of the Republic of Karakalpakstan, areas, the city of Tashkent and public vessels (further - qualification boards of judges of courts of law).
Article 2. The highest qualification board of judges, Qualification board of judges of economic courts, qualification boards of judges of courts of law (further - qualification boards of judges) are created for consideration of the following questions:
disciplinary responsibility of the judge;
suspension or early termination of powers of the judge;
ensuring immunity of the judge;
assignments to the judge of qualification class;
organizations of work on matching and elections of jurymen;
control of observance of the judicial oath and rules of ethical behavior of judges.
Qualification boards of judges assist the Highest qualification commission on selection and the recommendation to positions of judges in case of the President of the Republic of Uzbekistan (further - the Highest qualification commission) in accomplishment of the tasks assigned to it.
Article 3. Qualification boards of judges perform the activities on the basis of the Constitution and the laws of the Republic of Uzbekistan, resolutions of chambers of Oliy Majlis of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, and also this provision.
Article 4. The highest qualification board of judges is elected the Plenum of the Supreme Court of the Republic of Uzbekistan for a period of five years from among judges of the Supreme Court of the Republic of Uzbekistan as a part of the chairman, his deputy and members of the Highest qualification board of judges.
The qualification board of judges of economic courts is elected to conferences of judges of economic courts of the Republic of Uzbekistan for a period of five years from among judges of the Supreme Economic Court of the Republic of Uzbekistan, economic court of the Republic of Karakalpakstan, economic courts of areas and the city of Tashkent as a part of the chairman, his deputy and members of Qualification board of judges of economic courts.
Qualification boards of judges of courts of law are elected at conferences of judges of the relevant courts for a period of five years from among judges of interdistrict, district (city) courts, district and territorial public courts and the relevant superior courts as a part of the chairman, his deputy and members of qualification boards of judges.
Article 5. The plenum of the Supreme Court of the Republic of Uzbekistan and conference of judges are competent to elect qualification board of judges if at them there are at least two thirds of the judges forming plenum or conference.
Article 6. The quantitative structure of qualification boards of judges is determined proceeding from amount of their work, but shall not exceed nine people, including the chairman of qualification board of judges and his deputy.
Article 7. Alternate members of qualification boards of judges are proposed as members of the Plenum of the Supreme Court of the Republic of Uzbekistan or conferees of judges.
Article 8. The judge is considered the elected to qualification board of judges if by results of vote received more than a half of votes of the judges who were taking part in vote.
Article 9. Qualification boards of judges inform on the activities the bodies which elected them at least once a year.
Article 10. The highest qualification board of judges, Qualification board of judges of economic courts:
1) is prepared by suggestions for improvement of the mechanism of selection of judges for submission to the Highest qualification commission;
2) is represented to the Highest qualification commission by the corresponding conclusions on candidates (judges) pushed for new term of office or to other judicial positions;
3) are notified on the opened vacant judicial positions of judges, and also persons included in reserve of the candidates for the first time appointed to positions of judges and last in training and training by placement of information respectively on official websites of the Supreme Court of the Republic of Uzbekistan and the Supreme Economic Court of the Republic of Uzbekistan;
