About modification and amendments in some legal acts
The Parliament adopts this organic law.
Art. I. - In the Code of the Republic of Moldova about offenses No. 218-XVI of October 24, 2008 (Official monitor of the Republic of Moldova, 2009, Art. No. 3-6, 15), with subsequent changes, to make the following changes and additions:
1. Add the code with Article 319-2 of the following content:
"Article 319-2. Non-execution of resolutions of Audit Chamber
Action or failure to act of the officials who without valid excuse are not carrying out resolutions of Audit Chamber in the time established by Audit Chamber
attract imposing of penalty in the amount of 200 to 350 conventional units.".
2. Add Article 349 with part (5) the following content:
"(5) Non-presentation without reasonable excuse of the data, information, acts or documents requested by Audit Chamber in terms and on the conditions established by the legislation
attracts imposing of penalty on officials in the amount of 100 to 150 conventional units.".
3. In part (2) articles 385 of figure "400-423-2". replace with figures "400-423-6".
4. In Item d) articles 393 of figure "400-423-5)". replace with figures "400-423-6)".
5. Add the law with Article 423-6 of the following content:
"Article 423-6. Audit Chamber
(1) Offences, stipulated in Article 319-2 and part (5) Articles 349, are established by Audit Chamber.
(2) protocols has the right to State offenses and to constitute the personnel of Audit Chamber given authority on public audit.
(3) Protocols on offenses are transferred for consideration on the merits to competent degree of jurisdiction.".
Art. II. - In the Law on Audit Chamber No. 261-XVI of December 5, 2008 (Official monitor of the Republic of Moldova, 2008, Art. No. 237-240, 864), with subsequent changes, to make the following additions:
1. Part (Article 26 to add 2) with Item e) the following content:
"e) establish the offense fact.".
2. Add Article 36 with part (3) the following content:
