About modification of Article 35 of the Economic Procedure Code of Ukraine concerning the bases of release from proof

The Verkhovna Rada of Ukraine decides:

1. Article 35 of the Economic Procedure Code of Ukraine (1992, 6, the Art. 56) to state sheets of the Verkhovna Rada of Ukraine to No. in the following edition:

"Article 35. Bases of release from proof

Circumstances which are recognized the parties and other persons participating in case can not be proved before court if the court has no doubt in reliability of these circumstances and voluntariness of their recognition.

The circumstances recognized by court well-known do not need proofs.

The circumstances established by the judgment in economic, civil or administrative case which took legal effect except established by the decision of reference tribunal, are not proved by consideration of another matters in which the same persons or person concerning whom these circumstances are established participate.

The court verdict in criminal proceedings or the court order on the case of administrative offense which took legal effect are obligatory for the economic court considering case on consequence in law of actions or failure to act of person concerning which the sentence or the court order is pronounced only in questions whether act took place and it is made by this person".

2. This Law becomes effective from the date of, its publication following behind day.
