About interpretation of Item 7 of article 6 of the law of the Kyrgyz Republic "About enforcement of the land code of the Kyrgyz Republic"

Article 1. Provision of Item 7 of article 6 of the Law of the Kyrgyz Republic "About enforcement of the Land code of the Kyrgyz Republic" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 1999, No. 9, the Art. 440) concerning recognition of the right of private property to the parcel of land behind the physical persons and legal entities which received them in accordance with the established procedure before enforcement of the Land code of the Kyrgyz Republic extends also to the parcels of land assigned to the buildings, constructions and rooms privatized according to the procedure, established by the legislation, before enforcement of the Land code of the Kyrgyz Republic, except as specified, when the parcel of land was provided in urgent (temporary) use.

On the parcel of land, in this case, privatization documents for the building and construction are considered as the title document.

Borders of the parcel of land are determined on the basis of the available documents allowing them to identify, in case of their absence - on the basis of preparation by the public land management service of the cadastral plan approved with owners of the adjacent parcels of land.

In case of right claim of other persons on borders of the parcel of land provision of the relevant documents by them is obligatory.

Privatization documents and the cadastral plan are the basis for registration of the property right to the parcel of land and the subsequent registration and issue of the state act of the right of private property to the parcel of land.

Article 2. This Law becomes effective from the moment of publication.
