In these cases the statement for issue of the duplicate of the executive document can be filed a lawsuit within a month from the date of when the claimant knew of loss of the executive document.
3. The statement of the claimant or judicial police officer-contractor for issue of the duplicate of the executive document is considered by court in judicial session in time, not exceeding ten days from the date of receipt of the specified petition. Persons participating in case are informed on time and the place of meeting, however their absence is not obstacle to permission of question of issue of the duplicate. In case of consideration of the application about issue of the duplicate of the executive document the court finds out the circumstances testimonial of loss of the executive document, and researches the proofs confirming its loss.
