About introduction of amendments to some laws of Ukraine concerning provision of information on state registration of the rights and their burdenings from the State register of the rights to real estate

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following laws of Ukraine:

1. Article 46.1 of the Law of Ukraine "About notariate" (Sheets of the Verkhovna Rada of Ukraine, 1993, No. 39, Art. 383; 2013, 23, 224) to state No. to the Art. in the following edition:

"Article 46.1. Powers of notaries in the field of state registration of the rights to real estate and their encumbrances

The notary as the special subject to whom functions of the state registrar of the rights to real estate are assigned and which has seal of such registrar performs powers according to the Law of Ukraine "About state registration of the corporeal rights to real estate and their burdenings".

The notary when making notarial actions with the real estate, object of construction in progress has access and uses the State register of the rights to real estate, performs search in it of data on the registered corporeal rights to real estate, object of construction in progress, encumbrance of such rights and in its results creates the statement of the State register of the rights to real estate which remains in office of notary public or the private notary.

Use of the State register of the rights to real estate is performed directly by the notary who makes the corresponding notarial action.".

2. In article 28 of the Law of Ukraine "About state registration of the corporeal rights to real estate and their burdenings" (Sheets of the Verkhovna Rada of Ukraine, 2010, No. 18, Art. 141; 2013, No. 23, Art. 224):

1) in part one:
