About the moratorium on collection of the property of citizens of Ukraine provided as providing foreign currency loans

The Verkhovna Rada of Ukraine decides:

1. During operation of this Law:

1) collection (aloof without the consent of the owner) the property carried to objects of housing stock (further - real residential estate), object of incomplete housing construction, property rights on it which is mortgage subject according to article 5 of the Law of Ukraine "About mortgage" cannot be compulsorily turned if such property / object of incomplete housing construction / property rights act as ensuring obligation fulfillment of physical person (the borrower or the property guarantor) on the loans granted to it by credit institutes - residents of Ukraine in foreign currency and provided that:

such real residential estate is used as the permanent address of the borrower / the property guarantor or is object of incomplete housing construction provided that the borrower or the property guarantor in property have no other real residential estate; or

such real residential estate was acquired for borrowing facilities and at the same time conditions of the credit agreement provide prohibition of registration of the residence of the borrower or property guarantor to the address of finding of real residential estate provided that the borrower or the property guarantor in property have no other real residential estate;

total area of such real residential estate (object of incomplete housing construction) does not exceed 140 square meters for the apartment and 250 square meters for the apartment house;

2) other property (property rights) which according to the legislation or the credit agreement is subject to collection from the borrower specified in the subitem of 1 this Item in case of insufficiency of the means received by the claimant from realization (revaluation) of subject of pledge (mortgage) cannot be compulsorily collected (aloof without the consent of the owner);
