About modification and amendments in some legal acts

The Parliament adopts this organic law.

Art. I. - In the Law on electronic communications No. 241-XVI of November 15, 2007 (Official monitor of the Republic of Moldova, 2008, Art. No. 51-54, 155), with subsequent changes, to make the following changes and addition:

1. To add article 2 after the concept "domain of the highest level .md" with the concept "equipment of electronic communications" of the following content:

"the equipment of electronic communications - any products produced by industrial method held for use in networks and/or services of electronic communications;".

2. In part (3) articles 7 Items h) and j) state in the following edition:

"h) provides assessment of conformity of the equipment of electronic communications;";

"j) exercises control of the equipment of electronic communications placed in the domestic market and/or put into operation, regarding compliance to the main requirements of the applied technical regulations.".

3. State Article 16 in the following edition:

"Art. 16. - (1) Import of the equipment of electronic communications is performed based on the contract of delivery with obligatory specifying in it the applied main requirements, with submission of the declaration of conformity published by the importer registered by certification body of products in the field of electronic communications according to the applied technical regulations.

(2) the Equipment of electronic communications is placed in the market only on condition of compliance to the main requirements, based on the declaration of conformity published under own responsibility by the producer, his authorized representative or the importer on the basis of technical documentation of the producer, confirming products compliance or based on the certificate of conformity issued by accredited and acknowledged certification body of products in the field of electronic communications. The equipment of electronic communications shall be marked according to the applied technical regulations.
