Article 1. To state Article 19 of the Civil code of the Republic of Armenia of May 5, 1998 (further – the Code) in the following edition:
"Article 19. Protection of honor, advantage and goodwill
1. Honor, advantage, goodwill of person are subject to protection from publicly stated other person of insult and slander in cases and the procedure established by this Code and other laws.
2. Upon the demand of interested persons protection of honor, advantage of the citizen and after his death is allowed.
3. If establishment of person who spread the information discrediting honor, advantage or goodwill of person is impossible, then person on whom the similar information was spread has the right to take a legal action with the requirement to recognize the spread information untrue.".
Article 2. In article 22 of the Code of the word "Article 19" shall be replaced with words "Article 1087.1".
Article 3. To add Chapter 60 of the Code with paragraph 2.1 of the following content:
"§2.1. Procedure and conditions of the indemnification caused to honor, advantage and goodwill
Article 1087.1. Procedure and conditions of the indemnification caused to honor, advantage and goodwill
1. Person, honor, advantage or goodwill of which are slandered by insult or slander, can take a legal action against the person who caused to it insult and slandered him.
2. In sense of this Code insult is the public expression stated by means of the word, the image of sound, sign or otherwise with the purpose to slander honor, advantage and goodwill.
In sense of this Code public expression in this situation and on the content can not be considered as insult if it is based on established facts (except for natural defects) or is caused by the highest public interest.
3. In sense of this Code slander is public idea of person of such actual data (statement of fact) which are not true and discredit his honor, advantage and goodwill.
