About establishment of additional requirements to the name of grade of plant and recognition No. 1152 which voided resolutions of Council of Ministers of the Republic of Belarus of September 8, 2009

According to article 3 of the Law of the Republic of Belarus of January 4, 2014 "About modification and amendments in some laws of the Republic of Belarus concerning legal protection of plant varieties" the Council of Ministers of the Republic of Belarus DECIDES:

1. Determine that the name of grade of plant:

1.1. it is specified with use of letters of the Latin or Cyrillic alphabet, figures, gaps.

The name of grade of plant containing letters of the Cyrillic alphabet is transliterated by the applicant in letters of the Latin alphabet, and such name which is written down with use of Latin letters - in Cyrillics with respect for phonetic identity of names. All transliterated names of grade of plant are considered as its same name. Transfer of the name of grade of plant from Russian or into Russian is not allowed;

1.2. is distinguishable from the name of other grade of plant if the graphical and phonetic difference between names of grades is provided;

1.3. shall differ from:

1.3.1. names of already existing plant varieties if these plants belong to the same botanical sort or enter the same class;

1.3.2. names of the plant varieties which are on the state testing of grades;

1.4. shall not:

1.4.1. contain forms of words in comparative or superlative degree;

1.4.2. consist only of figures, except as specified, if it is the commonly accepted practice in case of the name of grades of separate plants (for example, plants of parent lines);

1.4.3. mislead rather quality characteristics of plant varieties, including by creation of false impression that the grade of plant is connected with other grade or derivative of it, and also concerning its geographical origin;

1.4.4. contradict the principles of humanity and morals;

1.4.5. contain references to the trademarks, service marks, trade names and other data allowing to establish prohibition on use of the name of grade of plant.
