About modification and amendments in the Code of penal procedure of the Republic of Moldova No. 122-XV of March 14, 2003

In the Code of penal procedure of the Republic of Moldova No. 122-XV of March 14, 2003 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 248-251, 699), with subsequent changes to make the following changes and additions:

3. Add Article 63 with part (1-1) following contents:
"(1-1) Resolution on recognition of person by the suspect and information on the rights, stipulated in Article 64, are brought to the attention of person within 5 days from the moment of pronouncement of the resolution, but no later than appearance day of the suspect or its drive or the moment of the beginning of production concerning it the first legal proceeding. In case of need purposes of special search events concerning the suspect acquaintance of person with the resolution on recognition by his suspect and information on its rights is postponed with the permission of the judge on criminal prosecution based on the motivated resolution of the prosecutor for 30-day term with possibility of its reasonable prolongation until 3 months. In case of the crimes relating to organized crime, money laundering, the crimes of terrorist nature, corruption crimes and crimes connected with corruption, the term of adjournment of acquaintance can be prolonged up to 6 months with the permission of the judge on criminal prosecution based on the petition of the prosecutor. Each prolongation of term of adjournment of acquaintance of person with the resolution on recognition by his suspect and information on its rights cannot exceed 30 days.".
